MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 14, 2024 <br /> Mr. Kieran Healy, Land Surveyor with the BSC Group represented the homeowner. At the last <br /> hearing, the Board wanted confirmation that the height of the wall in the rear is less than 4 ft. or it <br /> would be considered a structure. The measurement was confirmed from the bottom of the footing <br /> to the top of the wall is less than 4 ft. The second item was the percent lot coverage. Mr. Healy <br /> said that the percent lot coverage calculations, 38.8% existing and 40.1%proposed,were based on <br /> the new flood plain regulations. The new calculations based on the existing 18,686 sq. ft. existing <br /> lot area is 14.2% existing, and 14.6%proposed. <br /> Mr. Reidy read the Board of Health comments dated August 9, 2024 into the record; `No <br /> comments", and the Conservation Department comments dated August 12, 2024 into the record; <br /> "Resource Areas: Riverfront buffer zone to the Mashpee River, and buffer zone to Coastal Bank. <br /> RDA permit application for installation of a swim spa in place of existing impervious patio <br /> received a negative determination with a unanimous vote. Existing area is hardscape patio with <br /> no expansion of hardscape footprint and native plantings on the coastal bank. " <br /> The Board confirmed that the calculations were added to the site plan as requested. The Board also <br /> wanted to confirm that the pool would be drained by a vacuum truck. This notation was on the <br /> revised plan, and approved by the Conservation Commission in May 2024. <br /> There were no other questions from the Board. <br /> Mr. Furbush made a motion to close the public hearing. Mr. Blaisdell second. All were in favor. <br /> Mr. Reidy made a motion that the Board issue a Written Finding under §174-17 and §174-33 to <br /> Mr. Robert Valetta at 112 Captains Row, Mashpee, MA with the following conditions: <br /> l. The Board has determined that the applicant meets all the conditions of a Written Finding <br /> under Mass General Law 40A Section 6. <br /> 2.
