MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> DECEMBER 14,2022 <br /> He wanted to know how this is allowed under Section 174. He said that the Commission listens <br /> and acts on order of conditions that are contained within their purview. <br /> Mr. Colombo said he voted not to approve this project because he didn't life the setup of the septic <br /> system, and questioned whether the test hole is weeping water etc.'He is questioning how a house <br /> foot print can double when the entire lot is subject to coastal flow. He said that this was his first <br /> time at a zoning Board Meeting, and the comments that are read into the record and conditioned <br /> approved from the Commission are not unanimous approvals and may have concerns. <br /> Mr.Bonvie,as Acting Chairman explained that the Board has their rules and regulations to follow. <br /> Any letters submitted to the Beard from any Committee that are read into the record holds a lot of <br /> weight especially if there are concerns regarding variances,setbacks from wetlands,etc.The Board <br /> will read these comments only knowing and reading what is submitted. These comments are also <br /> submitted to the Zoning Enforcement Officer who oversees flood, setbacks, etc. Mr. Bonvie said <br /> that if there are more detailed comments from the Commission to the ZBA, it will certainly be <br /> taken into consideration.,The Board trusts the judgment from the other Departments, and if there <br /> are any issues,they are discussed at the hearings. <br /> Mr. Bonvie said that land outside of coastal flow is not in reference to lot coverage. At Town <br /> Meeting the community voted and approved the raze and replace bylaw. The Board agreed that lot <br /> coverage is a very important component for these type of projects. The Board is very careful to <br /> make sure that these raze and replace projects remain within their allowed lot coverage. The area <br /> within coastal flow is generally not part of lot coverage. The tat coverage is discussed with the <br /> Zoning Enforcement Officer. <br /> Mr. Colombo questioned why the square footage of a lot that is totally within land subject to coastal <br /> flow can be utilized. He said that bath the State under 131-40, and the Town of Mashpee under <br /> 172 Regulation 25, says; no,that it's wetlands. <br /> Mr. Bonvie suggested that Mr. Colombo speak with Evan, Town Planner, and with the zoning <br /> Enforcement Officer. The ZBA follows the guidelines on lot coverage that are from the zoning <br /> Enforcement Officer. <br /> Mr. Colombo mentioned he had a conversation with the Select Board and recommended that all <br /> the Department Chairs of any regulatory Board and Commission meet on a regular basis to discuss <br /> these type of issues that are problematic to enforce. He said that he loops at the guidelines of <br /> Concom Board of Health,and zoning,and are very easy projects that seem to slip under the radar <br /> and end up being approved when in one venue or another may have not been approved. <br /> Mr. Bonvie said that the Zoning Board has certain guidelines to follow, and unless a decision has <br /> been made that says lot coverage should not be included,but at this point in time this has not been <br /> the guidance. <br /> 8 <br />
