MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> NOVEMBER 9, 2022 <br /> Ms. Sangeleer read the Board of Health comments into the record; "Not a habitable space, no <br /> increase in septic flow. To remain 3 bedroom house."Conservation Comments; "Property lies within <br /> the 100 year flood plain but all proposed work is interior/immediate exterior.No permit required." <br /> Ms. Sangeleer read the Town Planner comments into the record; his first question to the Board <br /> was, "if the enclosure of the deck/balcony is considered more detrimental than what existed <br /> previously." Mr. Furbush, Mr. Blaisdell, Mr. Goldstein, Mr. Gould, and Ms. Sangeleer did not <br /> have any issues. <br /> Ms. Sylvester commented that the original home was a very small cottage, and the new home will <br /> be similar to the other structures in the neighborhood. <br /> Ms. Sangeleer read the Town Planner read the second question to the Board; "does the roof deck <br /> exceed 100 sq. ft., and would it require a Variance. Mr. Blaisdell commented that the Board is <br /> only to discuss the petition that is before them, not to discuss the roof deck and if it was approved <br /> at the prior hearing, then it should be discussed with the Building Commissioner during the <br /> permitting process. <br /> Mr. Morris said that it should be under interpretation. He read the bylaw Section 174-31 fn.: 4 <br /> regarding roof decks. Mr. Goldstein mentioned that the Board has approved roof decks in the past. <br /> Mr. Blaisdell said in his opinion, the roof deck question should not be discussed at this hearing. <br /> Mr. Goldstein agreed. Mr. Gould agreed, and Mr. Furbush agreed. <br /> There were no comments from the audience. There were no more comments from the Board. <br /> Mr. Goldstein made a motion that the Board issue a Modification to Greg Clancy Construction to <br /> an issued Special Permit(SP-2022-06)under §174-24 (C) (9) (d)to change the second floor porch <br /> into an enclosed office space, and adding six (6) windows (no change in footprint), on property <br /> located in the Popponesset Overlay District, and R-3 Zoning District, Map 118 Parcel 72, <br /> Mashpee, MA. (Owners of record: Laurie Mancinelli and Joseph Mancinelli) with the following <br /> conditions; <br /> 1. The Board accepts the Modifications to the issued Special Permit under Mass General Law <br /> 40A Section 9. <br /> 2. House Plans — Prepared for Mancinelli Residence, 18 Wilsons Grove, Mashpee, MA. <br /> Prepared by: Clancy Construction, Inc., Revision Date: 10/3/2022. <br /> 3. Conditioned on all Town Department comments read into the record. <br /> 8 <br />
