MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> NOVEMBER 9,2022 <br /> Mr. Gould seconded, yes, <br /> Ms. Sangeleer, yes, <br /> Mr. Goldstein, yes, <br /> Mr. Blaisdell, yes, <br /> Mr. Furbush, yes. <br /> All were in favor to issue a Modification. <br /> 42 S oondrift Way: Joint Stipulation of Remand Hearing ordered from Superior Court <br /> Barnstable, SS,in accordance with the August 25,2022 Civil Action No. 2272CV00191. Decision <br /> of the Board dated April 13, 2022. Owners, BEC MA Properties, LLC request a Special Permit <br /> under §174-17.1 of the Zoning Bylaws to raze an existing single story residential structure and <br /> replace the same with a new two story residential structure on property located in an R-3 Zoning <br /> District, Map 111 Parcel 127, Mashpee, MA. <br /> Sitting on this hearing are the four regular Board members and Mr. Caggiano. <br /> Attorney Kevin Kirrane represented the remand hearing in response to a 3-2 vote denial of a <br /> Special Permit seeking to raze and replace a single-family residential structure. Subsequent to the <br /> filing of the lawsuit,discussions with Town Counsel and the Conservation Commission were made <br /> and there were some concerns relative to the coastal bank being connected from one side to <br /> another. The revised plan that was submitted to the Board depicted two additional drainage basins <br /> recommended by the Conservation Commission, and there is written correspondence from Drew <br /> McManus, Conservation Agent indicating in his opinion, the additional measures add greater <br /> protection to the modification of the coastal bank that was initially approved by the Conservation <br /> Commission before this project was brought to the ZBA for the raze and replace project. <br /> Mr. Furbush read the email/letter dated August 2, 2022 from Drew McManus to Christopher <br /> Kirrane regarding 42 Spoondrift Way — Special Permit Denial. "Thank you for providing the <br /> revised plans showing the proposed drywells. I believe these should provide sufficient flood <br /> storage capacity on the property to alleviate any concerns of flooding".
