MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> NOVEMBER 9, 2022 <br /> Mr. Luff mentioned he had a conversation with Mr. Morris regarding the story above grade. If the <br /> lower level was in the flood zone,not habitable space,the client has to sign a document that it will <br /> remain unfinished space. The floor at the lowest level does not constitute a story. Therefore by <br /> definition, and the discussion with Mr. Morris, the dwelling is a story and a half. <br /> There were no more comments from the Board or audience. <br /> Mr. Goldstein made a motion that the Board issue a Special Permit for 44 Waterway to Owners, <br /> Linda H. and David A. Pierce under §174-17.1 of the Zoning Bylaws to raze and replace an <br /> existing non-conforming single family dwelling on property located in an R-3 Zoning District, <br /> Map 105 Parcel 208, Mashpee, MA with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 2.
