MAST PEE ZONING BOARD of APPEALS <br /> MEETING G MINUTES <br /> OCTOBER 12, 2022 <br /> Attorney Christopher Kirrane represented the application for a raze and replace project. Also <br /> present was Raul Lizardi-Rivera with Cape& Islands Engineering. This property non-conforming <br /> located in the Monomoscoy area of Mashpee. The lot is 5,707 sq. ft. with 114 of frontage. The lot <br /> does not meet the minimum requirements for lot size and frontage in the R-3 zoning District. The <br /> current conditions do not meet the front yard setback of 22.6', or the rear yard 15 ft. setback and <br /> is currently over the property line. The rear yard setback will be improved from o to 4.4 ft. The lot <br /> coverage will increase from 2 3.8% to 24.8% which is still under the 5% maximum allowed for <br /> lots under 10,000 sq. ft. <br /> The side yard setback will improve from.2.8 ft. on the easterly side to 29 ft. The front yard setback <br /> from 22.6 ft.to 12.2 ft. to move it from.the rear property line. The Attorney provided photographs <br /> of the surrounding properties. There are no new non-conformities being created. There is parking <br /> onsite,and will not be more substantially detrimental than ghat currently exists because the 1960's <br /> dwelling will become a more code compliant structure. The project was approved by the <br /> Conservation Commission, and eliminating one non-conformity, and eliminating the rear setback <br /> non-conformity. <br /> Mr. Blaisdell asked about the average setbacks from the other neighboring properties. Attorney <br /> irrane said he could not get that information in time for the Board, but he provided photographs <br /> of those properties. <br /> Mr. Blaisdell said that it looks like it is not more detrimental than what previously existed. <br /> Mr. Bonvie wanted to make sure that the project didn't require relief of the setback from wetlands. <br /> Mr. Blaisdell said that Conservation Commission approved the project, and he is satisfied. <br /> Attorney I irrane said that the property is under 10,000 sq. ft. <br /> Mr. Morris mentioned that this property has received a LOMA from FEMA.. <br /> An abutter(introduced herself but did not mention her address),had concerns with the distance of <br /> the new house from the road, and emergency vehicles accessing the road. <br /> An abutter spore (did not introduce himself, and had concerns regarding construction vehicles <br /> blocking the road. <br /> Mr.Lizardi-I.ivera commented that the house will be 12 ft. from the easement line.The roof runoff <br /> is corrected with down spouts and water will be directed to dry wells; this was approved by the <br /> Conservation Commission. There's no other proposed impervious surfaces for this project. The <br /> driveway is impervious material located over the septic system. The current system is about 20 ft. <br /> from the wetlands, and the new system will be 130 ft. away from the marsh on the opposite side <br /> of the house which is an improvement. <br /> 8 <br />
