MASHPEE ZONING BOARD of APPEALS <br /> MEETING MINUTES <br /> OCTOBER 12,2022 <br /> Attorney Christopher Kirrane represented the application. The property has two front setbacks, <br /> one is Seaview Avenue, and the other is Overlook Knoll Road. The property is non-conforming in <br /> both aspects; 20.2 ft. from Overlook Knoll and 22.5 ft. from Seaview. The setback requirement is <br /> 25 ft. The lot is also non-conforming to the east of the side yard setback. The existing is 13. 3 ft., <br /> and the westerly side is conforming at 16.9 ft. The lot coverage in the Popponesset Overlay District <br /> is 25%. The current lot coverage is 21.8%, and the proposed will increase to 22.7%. There are no <br /> new non-conformities being created. The Overlook Knoll Road rear and front yard setback will <br /> remain the same, the Seaview Ave setback will improve slightly from 22.5 ft. to 22.8 ft. The side <br /> yard setback will become conforming from 13.3 ft. to 15.1 ft. <br /> The home is a 1950's building will be replaced with a building code compliant building,and a new <br /> Title 5 Septic System will be installed. The Board recently approved a similar project at 17 <br /> Overlook Knoll road, and this project will not be substantially more detrimental than what <br /> currently exists. <br /> Attorney K.irrane mentioned that his clients will comply with the DPW Director comments <br /> regarding any water runoff to remain onsite. The plan that was submitted was not the most recent <br /> but he requested the Board could condition upon receiving a revised plan. There will be dry-wells <br /> installed. The proposed driveway will have the ability to contain the water onsite. The area on <br /> Seaview will have impervious surface and will not create any additional runoff. <br /> There were concerns mentioned regarding the new design of the driveway to be from front to back <br /> which currently allows vehicles to cut through from one street to the other street. His clients want <br /> to eliminate any vehicles driving on her lot. The new design will eliminate any vehicles driving <br /> through from one street to the next street. <br /> The Board had a conversation regarding driveway issues that exist with the homes in this <br /> neighborhood. <br /> Mr. Morris mentioned to the Board that he does not have any authority over driveways. He was <br /> under the impression that each association would require permission, but Overlook Knoll Toad is <br /> not part of the Popponesset Beach Association, and Seaview road is part of this association. <br /> Mr. Bonvie wanted to confirm the required corrections to the plan, one is the drainage to remain <br /> onsite, and the second is the driveway. The driveway on Overlook Knoll Road will be paved, but <br /> will have an infiltration system. The Seaview Ave area will be impervious. A motion could be <br /> made that all water runoff will be captured and retained onsite. <br /> 12 <br />
