MINUTES January 20, 1994 5 BOARD OF HEALTH Mr. Greelish informed Ms. Saunders, "This Board appreci- ates your point of view. " "The problem is this Board doesn't have any latitude. " "Whatever your neighbor decides to do, in terms of timetables, controls your fate and there is noth- ing this Board can do one way or another. " "This Board is already operating beyond its authority in not doing anything. " Ms. Saunders stated, "The Board is sitting here telling me that I am going to absorb some kind of expenses that I may not be able to do. " "Is this Board going to absorb expenses. " Mr. Greelish responded, "Unfortunately not. " Ms. Saunders relayed, "Then you are going to have to give me some time to work this out. " Mr. Greelish relayed, "We do not have the authority to do so. " Mr. Fitzpatrick stated, "I will give Ms. Saunders until February 3 , 1994 ." "I expect the town to inspect the system at that time or the day after and if need be condemn the property. " *****NEW BUSINESS***** John Slavinsky - _ 71Bluff Avenue Mr. John Slavinsky, P.E. was in attendance for this scheduled appointment. Mr. Slavinsky stated, "This plan was before the Board a few weeks ago at which time the Board denied the plans as they did not meet Title V requirements. " "The owner is ap- pealing the Board's decision as the installation of a Title V system would disrupt much of her landscaping. " Mr. Greelish questioned Mr. Slavinsky as to whether flow diffuser's could be installed. Mr. Slavinsky responded, "Yes. " "The system, as it cur- rently exists, is to close to groundwater. " Mr. McQuaid commented, "What is being proposed does not provide 4' of naturally occurring permeable soil below the bottom of the leaching facility. " Mr. Slavinsky stated, "It will once we fill it in. " Mr. Doherty questioned whether soils were suitable.
