MINUTES May 18, 1995 5 BOARD OF HEALTH <br /> "We have a signed statement from the owner indicating they will not increase living space <br /> because of the local variance we granted from the wetlands indicates their intention and <br /> concerns in protecting the environment." <br /> Mr. Bali questioned Mr. McQuaid, "Was a Title V hearing required.?" <br /> Mr. McQuaid responded, "No, because this was not a Title V variance required." <br /> Mr. Doherty questioned Mr. Doyle, "Is the retaining wall going to be fully below <br /> grade?" <br /> Mr. Doyle responded, "In some areas there will be about 6" of the wall exposed." <br /> "The reason for that is so we can control the grade." <br /> Ms. Duffy questioned Mr. Doyle, "Will there be a run-off onto my property from <br /> the grading?" <br /> Mr. Doyle responded, "No, that's why we're leaving a lip on the wall." <br /> Mr. Duffy stated, "We would like some sort of guarantee that there won't be any <br /> run-off from the system." <br /> Mr. Doyle commented, "There should be no run-off problem, it should be <br /> controlled by the lip of exposed wall along the property line." <br /> Mr. Duffy questioned Mr. Doyle, "Can you guarantee that in writing?" <br /> Mr. Doyle responded, "It's on the plan." "You'll have to ask the property owner <br /> if he wants to guarantee anything." <br /> Mr. McQuaid stated, "I think the important thing for the Board to consider is that <br /> this is a voluntary upgrade from two cesspools that are closer to Deans Pond then the <br /> proposed Title V system." "The owner has signed an affidavit, in spite of the fact that he <br /> is voluntarily upgrading to a Title V system, he will not increase living space." "That is a <br /> significant guarantee on the part of the owner." <br /> Mr. Doherty questioned Ms. Duffy, "Your major concerns were the exposure of <br /> the retaining wall and possible water run-off." <br /> Ms. Duffy responded, "Yes." <br /> i <br />
