MINUTES September 21, 1995 2 BOARD OF HEALTH <br /> Board members agreed to forward the letter as prepared by Mr. McQuaid. <br /> 5.) Letter to Town Counsel re: Well/sgptic setback - MF. McQuaid relayed, "The <br /> Board instructed me to propose a draft policy as far as our 100' to 150' setback <br /> requirement." "I had a difficult time preparing this as I don't fully support it." "My first <br /> instinct was to contact Town Counsel to ensure the Board could legally require more <br /> advance treatment in subdivisions that were previously approved by bath the Planning <br /> Board and Board of Health." "Attorney Teehan suggested I formally request his opLiion <br /> in writing on the matter." <br /> Board members agreed a legal opinion should be sought on the matter. <br /> b.) Variance request, 101 Pines Road - Mr. McQuaid relayed, "This is a pre-existing <br /> subdivision with well and septic layouts." "I do recommend we request the owner to sign <br /> the affidavit once town water is available." <br /> Mr. Ball motioned to grant a 22' local variance from the proposed on-site well to <br /> the abutting leaching facility, (997 Great Pines Road), a 40' local variance from the <br /> proposed on-site well to the proposed on-site leaching facility and a 8' local variance from <br /> the proposed on-site leaching facility to abutting well, (#9 Shadbush Circle) with the <br /> stipulation the owner sign the affidavit which agrees to tie in to town water once available, <br /> Mr. Cram seconded, all agreed. <br /> 7.) Emergency failure certification, 83 Troon Way - Mr. Evans relayed, "I inspected <br /> the site and found the cesspool full." <br /> Board members forwarded their signatures to the "Emergency Repair <br /> Certification" form. <br /> 13.F.I. Qm House - Acknowledged. <br /> High School Principal Reception - Acknowledged. <br /> *****OLD BUSINESS'" <br /> Request for Board's reconsideration - 41 Pond Circle <br /> Mr. McQuaid relayed, "The owner is requesting the Board reconsider their vote of <br /> September 7, 1995 which denied a request for local variance relief." <br />
