. MINUTES July 1, 1999 2 BOARD OF HEALTH <br /> proposed soil absorption system at 175 South Sandwich Road. Mr. Doherty <br /> seconded the motion. Motion passed. <br /> 2. Approve minutes of June 17, 1999 <br /> Mr. Cram motioned to approve the minutes of the June 17," 1999 meeting. Mr. <br /> Ball seconded the motion. Motion passed. <br /> Approve minutes of June 24, 1999 <br /> Mr. Cram motioned to approve the minutes of the June 24, 1999 meeting. Mr. <br /> Ball seconded the motion. Motion passed. <br /> OLD BUSINESS <br /> Retail food & tobacco permits - Dick & Ellie's Flea Market <br /> Mr. McQuaid gave a brief background of the food permit requests by East Coast <br /> Wholesale and Humberto Perreira and the tobacco sales permit request by East <br /> Coast Wholesale. <br /> a. Mr. Doherty motioned to grant a retail food permit to East Coast Wholesale with <br /> the stipulation that it is for pre-packaged, processed, non-perishable foods only. <br /> Mr. Ball seconded the motion. Mr. Cram was opposed. Motion passed. <br /> b. Mr. McQuaid stated, "I think the tobacco control program on Cape Cod has <br /> been very, very active in getting different towns to adopt tobacco control by-laws <br /> including the required permit to sell tobacco products. The intent is to make it <br /> as difficult as possible, if not impossible, for minors to access tobacco. I don't <br /> know what kind of control is being proposed to avoid that because I can see, on <br /> a busy day at the flea market, kids walking by and grabbing cigarettes. That is <br /> prohibited under our tobacco control regulation right now. I don't think there <br /> is any benefit to the community to allow an outlet for the sale of cigarettes at <br /> the flea market. I'm looking out for the public health. I recommend denial, but <br /> I have no vote in this matter." <br /> Mr. Vidal of East Coast Wholesale stated, "My tobacco products are kept inside <br /> of a fish tank inside of the stand. I pull them out and sell them as they are <br /> requested. I check ID's and make sure people are over 21 who buy the <br /> cigarettes." <br /> Mr. Ball asked, "Have you ever been caught selling to minors or caught in a <br /> sting?" <br /> Mr. Vidal responded, "Never." <br /> Mr. Doherty stated, "I'm not a big fan of tobacco, I'll tell you that right now. <br /> However, there are free trade issues. It is a regulated product and the Cape <br /> Cod Regional Tobacco Control Board does do spot compliance checks. You <br /> never know. You have to sell a lot to recoup a $500 fine. I don't like this in all <br /> honesty. I really don't think there is a need there, but I'm not here to impede <br />
