It also needs State <br /> concurrence. Mr. Dedecko is looking for a Certificate of Occupancy and we've <br /> run into a situation where he needs State approval and he wouldn't be able to <br /> receive that prior to the closing on the home. The buyers of the house have no <br /> place to live other than.this house as they have sold their home off-Cape. <br /> Originally the Board never approved the installation of the FAST system; it was <br /> overlooked." <br /> Mr. Dedecko stated, "We came in for a variance which was allowed. I had no <br /> idea. I thought I was doing everything the way it was supposed to be done. <br /> About 2 weeks ago I contact John Rowland from the FAST system and I asked <br /> him to get the system to put it in. It was brought to my attention that things <br /> have changed in the Department of Environmental Protection and that they <br /> now want a DEP number that corresponds with the system in.order to get the <br /> system from FAST. Without that he won't release the system to me." "I believe <br /> that this needs to now be approved as a general use system." <br /> Ms. Warden agreed, "The Board needs to approve this system for general use <br /> and then it has to go to DEP so that they can concur with that. However, in the <br /> mean time, the Board needs to consider granting a temporary occupancy <br /> permit." <br /> Mr. Dedecko stated, "I would sign a stipulation that as soon as the DEP <br /> paperwork is completed and my application is in... The process could take as <br /> much as 30-60 days. That's why I'm here tonight to see if I can get the <br /> approval for the temporary occupancy permit so I can move ahead with this. Or <br /> else I'll have to go back to these people who are buying the house." <br /> Mr. Doherty stated, "An occupancy permit states to a prospective buyer or to a <br /> bank that the house is fit for human habitation. Without a working septic <br /> system it is not fit for human habitation." <br /> Mr. Dedecko stated, "The system is in." <br /> Mr. Doherty continued, "If we grant an occupancy permit, the Town assumes a <br /> certain amount of responsibility or liability for that, which we really can't, not <br /> without the DEP concurrence. However, if you were to sign a statement that <br /> you are proceeding at your own risk, all of the liability would be on you, not the <br /> Town." <br /> Mr. Dedecko stated, "I would be willing to do that." <br /> Mr. Doherty motioned to grant general approval for a FAST system and to grant <br /> a temporary occupancy permit at 28 Jones Road with the stipulation that the <br /> Board receives a statement of liability from Mr. Dedecko, a DEP concurrence <br /> letter and the operation and maintenance contract. Mr. Santos seconded the <br /> motion. Motion passed. <br />
