MINUTES April 13, 2000 3 BOARD OF HEALTH <br /> APPOINTMENT: Linda Hardin re: 35 South Sandwich Road (buildabili�]d <br /> Mr. & Mrs. Harding were in attendance for this scheduled appointment. <br /> Ms. Harding stated, "I'm just here tonight to ask for an opinion. We own a lot on <br /> South Sandwich Road." <br /> Mr. McQuaid stated that the only information on file is a perc test from 1984. There <br /> were plans submitted and approved for a three-bedroom home in 1985. <br /> Ms. Harding stated that she wasn't aware of the Title V change that went into effect on <br /> January 1 sC which would limit the number of bedrooms on this lot. She further stated <br /> that she missed the deadline to file plans to allow a 3-bedroom home. A one-bedroom <br /> home would only be allowed now, or a 2 bedroom with a denitrification unit. Ms. <br /> Harding stated that her husband has had continued medical problems and that they <br /> need to sell the lot to pay his medical bills. She asked to allow the abutting open <br /> space to be used in the nitrogen loading calculation. <br /> Mr. Ball stated that the Board would not allow the open space to be used in the <br /> calculations. <br /> jDiscussion took place regarding the groundwater elevation and the options available <br /> to the applicant including composting toilets. <br /> Board members recommended that Ms. Harding contact DEP to see if they would <br /> approve a variance to Title V based on their hardship and that the property had been <br /> approved for a 3-bedroom home in the past and a septic permit issued. If DEP would <br /> allow the variance, then the applicants should then come back to the Board of Health <br /> for consideration. <br /> Mr. Ball stated that if DEP approved the variance request, then he would agree as well. <br /> APPOINTMENT: David Carboneau re: Carbo's smoking section <br /> Mr. Carboneau was in attendance for this scheduled appointment. <br /> Mr. Carboneau stated, "Air Cleaning Specialists came in to evaluate what I would <br /> need. The unit they proposed would clean the air 15 times per hour which is more <br /> than is required, I believe." "He mentioned that the smoke.would never get into the <br /> dining room because of the negative airflow where the bar is located. There used to be <br /> smoking when it was the Deer Crossing Market." <br /> Mr. Doherty expressed his concerns about the staff having to walk through the <br /> smoking area to serve their customers. He also questioned the amount of business <br /> lost due to the restaurant being non-smoking. <br /> Mr. Doherty stated that there are 20' ceilings and that 80% of the employees in the bar <br /> business smokes. All of his bartenders and everyone in the kitchen already smokes, <br /> as do some of the waitstaff. Mr. Doherty stated that he wants to protect the employees <br /> in addition to the patrons. <br />
