i <br /> MINUTES April 13, 2000 4 BOARD OF HEALTH <br /> Mr. Santos questioned whether there is a 6 wall to separate the bar area from the <br /> dining room. Mr. Carboneau stated that there is and that the Air Cleaning Specialists <br /> have stated that there is a negative airflow and that none of the smoke would enter the <br /> dining room. He stated that he is just the same as all of the other restaurants in town <br /> but that he is having a hard time competing with them due to the lack of smoking in <br /> the bar area. <br /> Mr. Ball commented that he doesn't have any problem with this. <br /> Mr. Santos stated that he would like more information. Mr. Doherty and Mr. Santos <br /> stated that they would like to visit the restaurant to see the set-up and that they <br /> would also like to see the maintenance contract with the air cleaning company. <br /> Board members decided to continue this item until they can visit the site and see the <br /> maintenance contract. <br /> APPOINTMENT: Mr. Steven Silva re: 105 Timberland Drive denite elimination <br /> Mr. Silva was in attendance for this scheduled appointment. <br /> Mr. McQuaid stated that the lot was approved for a 2-bedroom house a year ago and <br /> that due to the square footage a denitrification unit was required. Mr. Silva scheduled <br /> the appointment to see if the Board could reconsider this requirement. <br /> Mr. Silva stated, "Based on, 1 paid back taxes on the property when I purchased it, <br /> which was over $11,000, based on a half an acre. The property has been assessed as <br /> a half an acre." <br /> Mr. McQuaid stated that there is a discrepancy between what the plan shows and <br /> what he's paying on. <br /> Mr. Doherty stated, "When a system can't be designed in compliance with linear <br /> distances as specified in Title V and the town regulations, then you apply for a <br /> variance. In order to get a variance you need to show that the work that you'll be <br /> doing, and that the ultimate product of the septic system, will do no more harm than <br /> it would under the normal circumstance. In other words, if you have 100', that 100' of <br /> distance between, let's say the water and the edge of the leaching field provides a <br /> certain amount of filtration of the effluent when the wastewater moves through it. <br /> Now you are saying that you don't have that 100' and that you need less than that. <br /> OK, fine, the burden now shifts to you to provide that same level of protection. What <br /> we've done in town is said that if you go below 100' then we require a denite which <br /> buys you down to 75'." "You need at least 100' separation between a system and a <br /> body of water in order for it to be considered safe and effective. You don't have that <br /> 100' distance. The plan is showing 92' and 83'. Those linear distances alone, <br /> regardless of the size of the lot would kick in the requirement for a denite system. <br /> No action was taken on this agenda item as a denitrification unit is required for the <br /> soil absorption system to be located less than 100' from the adjacent body of water. <br />
