12
and weren't addressed satisfactorily. It really bothers him and the BOH will
address that internally. He would relate this to a food poisoning situation where
EMT's why don't you do something about that restaurant we are always getting
sick there. His response to them "Did you report it?" It bothers him that the BOH
did not know. Did it not come from the health agent to the members of the BOH?
He will look into the records and the file and find out. He recalls having talked
about Lapio's farm in the past. However, he doesn't remember complaints like this.
Maybe he is wrong. But, it hasn't been in a while. When you get one and then
another and you see a lot of complaints you start to have something to go on.
Obviously this has come to a head otherwise you wouldn't be here. He is not saying
that nothing is going to be done. They will address the situation as the law
provides. As far as the zoning issues are concerned there are a lot of structures in
town that were there prior to town line zoning. When the town was very young you
just threw up anything anywhere. There was no zoning. Then zoning came along.
Then they said what do we do with these old buildings. Well, these are pre-existing
non-conforming. They were here. They don't conform to our current zoning law.
But, everybody has the right develop land. We aren't just going to go around and
say, "well we don't want it there anymore. You have to tear it down." It just doesn't
work that way. The fact of the matter is that it's there and we are going to have to
live with it within reason. He didn't want to come across with the wrong impression
to say that we are not going to do anything. We are going to look at it. We are going
to work with Mrs. Murphy. This is not a board that is usually heavy handed.
Mr. Coughlin the interrupted Mr. Doherty and stated that he believed that they
have all exercised different levels of patience with the Murphys. He then reiterated
that Mr. Doherty said that he lived next door to a barn. He asked Mr. Doherty what
they feed their horses.
Mr. Doherty responded that his next door neighbor has a barn. They feed them
"ormoline" and hay.
Mr. Coughlin then stated that he would rather not become a familiar face in the
health department and make this a big issue. Like he said he spoke with Mr.
Murphy on numerous occasions and had a civil relationship with the gentleman.
He tried to continue it. Things decayed. It happened. They were the holdouts.
Everyone received there certified letters. He came to him and said, "Rick if there is
problem please come to me and we'll work together and try to get through it." Then
the horse ran through his yard. When he addressed that it was the girl fell off the
horse and got a concussion, which is not what he wants to hear on his
homeowners policy. He also doesn't want to hear about a little kid falling off a
horse in his yard. He stressed to you before that the sanitation issue was covered.
Let's work on containment. Mrs. Murphy obviously said that there is problem with
the fences. That needs to be addressed. If it hits the papers that a horse has
trampled a little kid then it is not this meeting anymore.
Mrs. Herrera then stated that the kids sit in the street and play hopscotch.
Mr. Doherty stated that he used to play hopscotch in the street when he was little.
