12
Mr. Ball then asked if everything that Mr. Pesce wanted was to be found in the
letter dated 10.09.01,
Ms. Warden replied that everything but the mounded system.
Mr. Ball replied that they had already approved the items in the letter including the
mounded system.
Mr. Pesce didn't include it in the original letter. It was an omission. He did go line
by line with Mr. Harrington's fax to him.
Mr. Harrington replied that as a result he is still learning the Town's regulations.
He apologized for any inconvenience or misinformation.
Mr. Pesce stated that it was not a problem. He just wanted to make sure that he
hadn't missed anything.
Mr. Doherty then asked if everyone was satisfied.
Ms. Warden stated that it was a learning experience and the BOH learned from the
experience.
Mr. Pesce told Mr. Smith that what the BOH needed was a copy of the deed
information.
Mr. Doherty stated that it could state that it requires a maintenance contract until
released by the BOH.
Mr. Ball made a motion to grant all of the variances requested in the Pesce
Engineering and Associates letter dated 10.09.01 as follows: 4' from the lot sideline
to the edge of S.A.S.; 5' from the foundation to the septic tank; 6' from the lot
sideline to the septic tank; 5' from the S.A.S. to foundation wall. This motion also
includes 75' down to 61.8' or a 38.2' variance. The final and fourth item would be
the approval of the mounded of the system only for the Clivus Composting Toilet
for this particular lot. Mr. Santos seconded the motion as long as the notification of
the abutters of the sideline variances is verified. Motion passed.
Mr. Harrington again asked Mr. Pesce if he had proof of the abutter notification.
Mr. Pesce stated that he did not notify them of this meeting because he was not
asked to do so.
Mr. Harrington asked if he had any verificatibn of the abutters from previous
meetings regarding property line variances.
Mr. Pesce stated that he had the white tags and the green cards. He then asked
when he could get the sign off from the BOH on the building department permit.
