13 <br /> Mr. Harrington stated that he would need proof of the abutter notification and the <br /> deed restriction. <br /> APPOINTMENT: Paul Kerrigan Occupancy Permit on 14 Oneida <br /> Mr. Doherty asked if Mr. Kerrigan or anybody representing Mr. Kerrigan was <br /> present. There was no response. <br /> Ms. Warden wanted to just discuss the fact that Mr. Kerrigan has made two or <br /> three attempts with the BOH and failed to show. She stated that the originally the <br /> Fast system was installed improperly. The installer had some sort of dispute <br /> between the installer and the owner. Mr. Kerrigan informed the BOH that it wasn't <br /> put in properly and was level with the driveway. She contacted John Roland of the <br /> Fast Company. They were having some type of dispute with the owner. The <br /> installer refused to provide as-built cards. Subsequent to that, Ms. Warden <br /> informed the owner that these issues needed to be resolved. She brought it before <br /> the BOH. The BOH required that the installer submit the as-built card. The BOH <br /> would not sign the occupancy permit until he accomplished that task. During the <br /> interim, John Roland from the Fast Company met with Mr. Kerrigan and resolved <br /> their differences. The system was installed properly. However, the installer <br /> continues to have a monetary dispute and would not sign off on the as-built card. <br /> The requirement remains that the installer submits the as built. The installer has <br /> not done so. The BOH has not signed off on an occupancy permit. Mr. Kerrigan has <br /> numerous other problems with the building department with illegal occupancy of <br /> the building. <br /> Again he has made two or three appointments with the BOH, one in writing which <br /> we refused and two separate appointments. <br /> Mr. Doherty stated that he is sure that he is going to want his occupancy permit <br /> sooner or later. <br /> APPOINTMENT: Cape & Islands, John Slavinsky, 172 Daniels Island Road <br /> Mr. Slavinsky was present for the applicant. The variance requests are as follows: <br /> The S.A.S. will be 6' off the abutters' property line. The S.A.S. will be 2' off the <br /> street property line. The S.A.S. will be 55' from the BVW. <br /> Mr. Slavinsky began by stating that before he even accepted the job from Dr. Per <br /> Eldh. He came before the BOH showing them what he had to work with at this <br /> particular site. The BOH replied by requesting that they put the leaching system as <br /> far away from the wetlands as possible and stick in a denitrification system. They <br /> have finally been approved by conservation. <br /> Mr. Doherty asked if they had previously approved this request. <br /> Mr. Slavinsky replied that it was preliminarily approved by the BOH. Conservation <br /> completely turned the project around. The addition went from one side of the <br /> house to the other side of the house. There are no additional bedrooms. <br /> Mr. Ball made a motion to approve the variances as follows: S.A.S. will be 4' off the <br />
