14
abutters' property line; S.A.S. will be 8' off of the street property line; S.A.S. will be
45' from the BVW.
Mr. Santos asked if the driveway was going over the abutter's property.
Mr. Slavinsky stated that it did now. The lot has all been surveyed.
Ms. Warden asked if the system was certified as a failure.
Mr. Slavinsky stated that it wasn't certified as a failure. However, if you go 3' you
get a cesspool 10' away from a wetland. It would be a serious failure.
Mr. Harrington stated that his only problem was that he wanted to confirm
bedrooms because it was a sizable addition. He hasn't seen a floor plan.
Mr. Doherty asked Mr. Slavinsky how many bedrooms there were right now.
Mr. Slavinsky replied that there were three bedrooms. A big part of the addition is
going to be a garage with a non-heated storage area, which Title V specifically
states will not be considered a bedroom. He will definitely give Mr. Harrington the
plans.
Mr. Santos seconded the motion with the stipulation that the health agents use the
building plans to certify that there are no bedrooms. Motion Passed.
APPOINTMENT: Cape and Islands Eng. 37 Shore Drive
The applicant is requesting the following variances: The septic tank will be 3 1/2'
off the crawl space. The soil absorption system and reserve soil absorption system
will be 7' off the street property line. The reserve soil absorption system will be 5'
off the northeast property line.
Mr. Harrington began by stating that he and Mr. Slavinsky did the perk test on
this property because of size constraints. The cesspool being in the back creates
the necessity for moving some of the plumbing inside the foundation of the rear
part of the house. The forward part is crawl space. It was determined that the
plumbing could be changed over to the rear left corner to come out the front to a
tank and leaching. They squeezed in a reserve area. If it were to be used they
would have to do something with the waterline. In it's current condition to the
primary it seems to be in compliance.
Mr. Doherty asked how the soil was up there.
Mr. Harrington replied that it was beautiful, running sand.
Ms. Warden asked if this was in failure. And did it require engineered plans.
Mr. Harrington replied that he believed that it had been in failure. He reviewed the
file and noted that the septic system did fail by inspection. He did not actually
certify it. The applicants went to engineered plans on their own.
