18 <br /> Mr. Doherty confirmed that he understood Mr. Slavinsky's intent and concern. He <br /> offered that the only alternative is a "strip-out" and the Town doesn't allow strip- <br /> outs. <br /> Mr. Slavinsky asked where Mr. Mahoney would go from here. <br /> Mr. James Mahoney, owner, entered the discussion at this point in time. He began <br /> by stating that the BOH called him a long time ago. They told him to "vent" it out <br /> and obtain some fill. He didn't want to speak too much because Mr. Slavinsky was <br /> here to do that for him. He gutted it all out, filled it and planted grass seed. He <br /> didn't want to do anything wrong. They told him from the BOH, in 1983, that he <br /> should take it all out and fill it up and get 5 or 10' higher. <br /> Mr. Doherty stated that that, in fact, could have happened at the time. <br /> Mr. Slavinsky interjected that they could have done that in 1983. <br /> Mr. Doherty then joined the conversation by introducing a letter that confirms <br /> what Mr. Mahoney was stating. There is a letter in file dated April 1st, 1982, from <br /> the Board stating several conditions. One of the conditions was the removal of the <br /> peat and silty sand down to 148" and replace with clean medium sand in 48" lifts. <br /> That condition was set. But, there were several conditions. There were leaching <br /> chambers, four on each side a deeded easement to the well. <br /> Mr. Slavinsky and Mr. Ball both stated that at this point in time that there is town <br /> water now. Mr. Slavinsky continued by stating that Mr. Mahoney didn't do it at <br /> that time. <br /> Mr. Harrington confirmed that those things were not complied with at that time. <br /> Mr. Doherty continued by stating that there were a number of dates where <br /> opportunities were missed bringing us to present day where nothing can be done. <br /> Even a zero discharge is a far-fetched idea. He doubted that even the state would <br /> go along with it. <br /> Mr. Mahoney entered the conversation again by stating that his father gave him <br /> that lot. He, personally, didn't have very much of value that is his own. Mr. <br /> Mahoney had a car accident when he was twelve. He is now forty-two years old. He <br /> had serious injuries. He broke his legs, seven ribs and sustained a massive <br /> hematoma to his head. Catscans and MRI's were not in existence at that time. He <br /> works for the Massachusetts Head Injury Association. They removed his cranium. <br /> He had to work with a speech pathologist. He was very limited in the money aspect <br /> of himself. His father passed away last March 31st, 2001. Things are rough. He <br /> doesn't want to be critical or do anything wrong. It is hard for him. He would like to <br /> build a home right there for himself. It is his mother and himself. His father put in <br /> the "rights of survivorship". He is going to use his money to build on that lot. <br /> Mr. Doherty stated that they couldn't get a septic system in that particular lot. <br />
