21 <br /> Mr. Doherty stated that this was the exact reason they made this policy. <br /> Mr. Slavinsky replied that the policy was created as a result of his activities on <br /> Whippoorwill Circle. <br /> Mr. Harrington's provided his opinion that the BOH would be "throwing the book <br /> out" to consider this request which is the bottom line. The BOH made several <br /> regulations prior to his being hired for this reason. They would be throwing them <br /> away unfortunately if you allow this request. There are other things to consider <br /> such as the hardship issues. But, there will be a long list of variances including <br /> state approval. He has a feeling that the state is not going to buy it. But, it is still a <br /> wait and see type of situation. <br /> Mr. Santos entered the conversation by stating that his biggest concern was the <br /> wetlands around that area. The groundwater with peat is an indication of <br /> wetlands. It is only seen with wetlands. Maybe if you dig down you will find the <br /> appropriate soil. But, he is very concerned with the lot's proximity to wetlands. He <br /> asked if the lot was a big hole. <br /> Mr. Slavinsky stated that it wasn't presently a big hole. Furthermore, he had no <br /> idea what it was like in the past. <br /> Mr. Mahoney joined the conversation again stating that the lot was ground level <br /> and nothing was wrong with it. One day, a cousin of his and her friend (He then <br /> interrupted the conversation to state that he also had epilepsy.) who had a bobcat <br /> pushed the dirt over to his father's house. He got the fill and kept putting it in over <br /> the years. <br /> Mr. Slavinsky suggested that what he could do to have a better understanding of <br /> the lot would be "topography" to get a better understanding of just how it looks. <br /> Then confirm with Bob Sherman or Diane Baretos to determine if this is in fact a <br /> wetland issue. He would then submit the information to the BOH. <br /> Mr. Doherty stated that he is a big fan of technology. If technology can find a way <br /> to get all interested parties through this particular situation-so be it. However, as <br /> Mr. Harrington stated, the BOH has specifically addressed this issue in the past. <br /> He is very, very reluctant to toss all this out. <br /> Mr. Mahoney continued by stating that he liked what "he" said about trying to get <br /> it "all settled right now." He was going to be disappointed if the BOH doesn't give it <br /> to him. <br /> Mr. Doherty replied that eleven years ago the BOH was pretty clear in their intent. <br /> Mr. Mahoney stated that he was sorry that he didn't comply with the BOH <br /> directives at that time. But, he wasn't in the position to do that at that time. <br /> Mr. Slavinsky stated that he told Mr. Mahoney that someone some landscaper put <br /> this high quality peat in place most probably for a garden of some sort.
