Even if it is on a second or separate floor with an <br /> open railing, it still has the ability for privacy. Mr. Harrington believes that this is a <br /> very strict application. Title V does allow the use of the deed restriction. Again, it <br /> isn't something that doesn't have to be dealt with tonight. But, is it a very <br /> important part of how they will approach floor plans. <br /> Mr. Doherty stated that this doesn't require a vote because the policy is already in <br /> place. It just needs to be reactivated. <br /> £ Smoking Control Regulations <br /> Mr. Doherty wanted to revisit a previous discussion regarding how proactive the <br /> BOH had been in establishing smoking regulations in the Town of Mashpee. The <br /> BOH were some of the first in the area and then they just let it be. They were well <br /> accepted in Town. They were drafted with the cooperation with the local <br /> restauranteurs and shop owners.The BOH invited them to sit with them and help <br /> hammer the regulations out rather than shoving them down their throats. It has <br /> been pretty good. Mashpee voters decided not to enact a total smoking ban. Even <br /> though he was theoretically in favor of it, he could not support it the way it was <br /> presented. It was not done correctly. Now with the summer behind us the BOH <br /> members have some time to think about the issue. The BOH has the fall and <br /> winter to revisit those regulations. One of the issues that he feels particularly <br /> strong about is that the seasonal visitors come to the Cape and just assume that <br /> all of the restaurants are high quality and high standards. There was another town <br /> in Massachusetts that came out with a grading system for their restaurants that <br /> required public posting. He has some rough ideas as to what should constitute an <br /> A, B or C rating and unless the other BOH members feel strongly against the <br /> proposal. He would like to pursue this over the fall. <br /> Mr. Harrington asked how the smoking regulations pertained to the restaurant <br /> grafi? <br /> Mr. Doherty posed, "Is it fair to down grade a restaurant from an A to a B because <br /> they allow smoking?" Probably.not, if they post a conspicuous warning that this is <br /> a non-smoking or smoking/non-smoking area provided. He does not think it is fair <br /> to affect the letter grade on the smoking issue. He would rather the letter grade be <br /> based on good performance on inspections and the record of complaints. He does <br /> not want to be a sneak and back door the issue and try to zing them that way. He <br /> is trying to give the unsuspecting tourist some help in determining where they <br /> might want to eat while providing some healthy competition between <br /> establishments to keep up with standards. <br /> y <br /> Mr. Ball interjected and said that he would like to take it a step further. He stated <br /> that he would like to come up with some type of policy that within a certain <br /> amount of time that each restaurant that allows smoking have some type of air <br /> quality testing done. If it doesn't meet a standard that the BOH sets that they have <br /> a certain amount of air quality equipment installed that helps to meet that <br /> standard. If they don't comply then the BOH will address the issue of no smoking. <br />
