ARTICLE 25. To see if the Town will vote to amend <br /> the Town By-Laws by adding the following Section: <br /> Section 4.5.13 Rental, Occupancy and Use <br /> Regulations <br /> a) No person shall rent or lease, or offer to rent or k� i <br /> lease, an building or an <br /> Y g y portion of a building, to <br /> be used for human habitation, without first regis- <br /> tering with the Board of Health,which shall deter- <br /> mine the number of persons such building or por- <br /> tion of a building may lawfully accommodate under I <br /> the provisions of the Massachusetts State San' <br /> star <br /> Y <br /> Code, and without first also conspicuously posting <br /> within such building or portion of a building a cer- <br /> tificate of registration, provided by the Board of <br /> Health, specifying the number of persons such <br /> v .. <br /> building or portion of a building may lawfully ac- <br /> commodate. ' <br /> b) No tenant shall lease,rent,or occupy any building , ,v <br /> or any portion of a building subject to the provisions " <br /> of this Section 4.5.13, if, at the time of such lease, <br /> rental,or occupancy,the number of persons occupy- <br /> ing such building or portion of a building exceeds <br /> the number of persons authorized to occupy such <br /> building or portion of a building by a certificate of + <br /> registration,if issued and posted,or if no certificate <br /> of registration is issued or posted, the number of <br /> persons that may be lawfully accommodated as de- '' 'I <br /> termined by the Board of Health under the Mas- An ,"i <br /> sachusetts State Sanitary Code. <br /> i <br /> c) As used in this Section 4.5.13, "person"means the IiG' <br /> owner of any building and his agent and employees,` " <br /> and includes an individual, partnership, corpora- t I' <br /> tion, trust or association. "Tenant" means tenant, I <br /> lessee,holder of a lease,and any licensee or invitee I' <br /> of such tenant,and includes an individual,partner- <br /> ship, corporation, trust or association. <br /> d) There shall be a fee of$5.00 paid to the Board of !� <br /> Health to procure a certificate of registration as Ips, <br /> called for herein. Any person or tenant violating <br /> any provision of this Section 4.5.13 shall be rl <br /> punished by a fine of not more than $300.00.
