Article40 <br /> To see if the Town will vote to authorize the Board of Selectmen to acquire by <br /> purchase or eminent domain for conservation purposes a conservation restrictioni <br /> access easements and/or similar less-than-fee interest in all, ora major portion, of a <br /> parcel of land of 16.2 acres, more or less, identified on the 1987 Mashpee Asses- <br /> sors' Maps as Map 16, Plot 4, generally located on Santuit Pond between Cotult <br /> Road, Tobey's Back Road and the northwest side of said pond, the said restriction <br /> and easements to be held in the care and custody of the Conservation Commission <br /> pursuant to Massachusetts General laws Chapter 40, Section 8C, said parcel of <br /> land being the same as that authorized for purchase in fee by Article 56 of the May <br /> 4) 1987 Annual Town Meeting; further, to see if the Town will vote to appropriate <br /> $400,000 or any other sum for such purpose, including expenses incidental and <br /> related thereto,and to raise such appropriation, the Treasurer, with the approval of <br /> the Selectmen, be authorized to borrow $400,000 or any other sum under and <br /> pursuant to Chapter 44, Section 7(3) and, if applicable, Chapter 40) Section 8C, of <br /> the General Laws) or any other enabling authority, and to issue bonds or notes of <br /> the Town therefor, with said bohdiinig,authorization contingent upon passage of a <br /> referendum to exclude the, principal. and interest on such debt from the tax levy <br /> limitation imposed by Chapter 59 Section 21 C of the General Laws (so-called <br /> Proposition 2 1/2); and.turther,-to s6e_ ifthe Town will vote to raise and appropriate <br /> or transfer from ayailable-funds $34 000, or any other sum, to the Santuit Pond <br /> Land Purchase Account to m <br /> provide.for interest and debt issuance expenses; further, <br /> to see if the Town will authorrze .the Board of Selectmen and/or Conservation <br /> Commission to apply for and accept.-Federal and/or State grants, including reimt- <br /> bursement under Chapter 1 Mk),Section 11 of the General Laws, to be applied by <br /> the Town toward the financing of this purchase, and to enter into contracts and <br /> agreements with Federal and/or State agencies, private conservation trusts, or <br /> other entities or persons in connection with the purchase of said interest and <br /> preservation for conservation purposes of all or a major portion of such land; and <br /> finally, to see if the Town will authorize the Conservation Commission and the Board <br /> of "Plectmen to enter into agreements and execute any and all instruments as may <br /> be necessary on behalf of the Town to effectuate said purchase and easements, or <br /> take any otheraction related thereto. <br /> . . . . . . . . . . . . . . . . . . . . . . . . . . 3 5 <br />
