Clerk, not later than seven days prior to the date of the vote hereunder and to authorize the Board of Selectmen to acquire by gift, purchase or eminent domain taking any land necessary for the purposes of such way as so laid out, and to raise and appropriate, transfer from available funds or borrow a sum or sums for such purchase or taking including borrowing costs therefor, and to further authorize the Board of Selectmen to assess betterments to the owners of the land abutting the ways. Submitted by the Director of Public Works Motion to accept the layout of Brewster Road, Chatham Lane, Harwich Road, Dennis Road, Truro Road as public ways as shown an plans entitled "Layout of Brewster Road, Chatham Lane, Harwich Road, Dennis Road & Truro Road, Located in Mashpee - Mass. " , dated March 2 , 1994 by Cape & Islands Engineering, which layout shall have been filed in the Office of the Town Clerk, not later than seven days prior to the date of the vote; that the Board of Selectmen are authorized to acquire by gift, purchase or eminent domain taking any land necessary for the purposes of such way as so laid out, That the sum of $253 ,000 be hereby appropriated, and authorized to be borrowed under and pursuant Chapter 44, Section 7, of the General Laws, or any other enabling authority, for such purchase or taking and layout, including costs of constructing such ways and legal, financing and other costs incidental and related thereto; and that the Board of Selectmen is authorized to assess betterments to the owners of the land abutting the ways. Motion carries by show of hands. Moderator declares 2/3rds vote. . . 10 :36 p.m. Count 82 yes. . . . . . 2 no ( 5/3) Article 32. To see if the Town will vote to amend Section 5 A. ( 3) of Mashpee Code Chapter 172 to read: "Any person filing a notice of intent with the Commission shall at the same time, after receiving written notice by the Commission of the date and time of the hearing required, provide a copy of said written notice to all property owners within one hundred ( 100) feet of the boundary of the property upon which the work is proposed, according to the most recent records of the Assessors, including those property owners across a way or a body of water and in another municipality. Said notice shall be certified mail, return receipt requested, and shall be in a form prescribed by the Commission. Said notice shall specify the time and date of the hearing, shall describe the proposed activity and the location thereof and shall state where the application and plans may be examined by interested parties. The Commission and/or its Agent may require the applicant to notify ( in the same forementioned manner) additional property owners within three hundred (300) feet of the boundary of the property on which the work is proposed. If such additional notification is deemed necessary by the Commission, notice of such shall be provided to the applicant with the written notice of the time and date of the hearing for said notice of Intent.
