Clerk, not later than seven days prior to the date of the vote hereunder and <br /> to authorize the Board of Selectmen to acquire by gift, purchase or eminent <br /> domain taking any land necessary for the purposes of such way as so laid out, <br /> and to raise and appropriate, transfer from available funds or borrow a sum or <br /> sums for such purchase or taking including borrowing costs therefor, and to <br /> further authorize the Board of Selectmen to assess betterments to the owners <br /> of the land abutting the ways. <br /> Submitted by the Director of Public Works <br /> Motion to accept the layout of Brewster Road, Chatham Lane, Harwich Road, <br /> Dennis Road, Truro Road as public ways as shown an plans entitled "Layout of <br /> Brewster Road, Chatham Lane, Harwich Road, Dennis Road & Truro Road, Located <br /> in Mashpee - Mass. " , dated March 2 , 1994 by Cape & Islands Engineering, which <br /> layout shall have been filed in the Office of the Town Clerk, not later than <br /> seven days prior to the date of the vote; that the Board of Selectmen are <br /> authorized to acquire by gift, purchase or eminent domain taking any land <br /> necessary for the purposes of such way as so laid out, That the sum of <br /> $253 ,000 be hereby appropriated, and authorized to be borrowed under and <br /> pursuant Chapter 44, Section 7, of the General Laws, or any other enabling <br /> authority, for such purchase or taking and layout, including costs of <br /> constructing such ways and legal, financing and other costs incidental and <br /> related thereto; and that the Board of Selectmen is authorized to assess <br /> betterments to the owners of the land abutting the ways. <br /> Motion carries by show of hands. ( 3) of Mashpee Code Chapter <br /> 172 to read: <br /> "Any person filing a notice of intent with the Commission shall at <br /> the same time, after receiving written notice by the Commission of <br /> the date and time of the hearing required, provide a copy of said <br /> written notice to all property owners within one hundred ( 100) feet <br /> of the boundary of the property upon which the work is proposed, <br /> according to the most recent records of the Assessors, including <br /> those property owners across a way or a body of water and in another <br /> municipality. Said notice shall be certified mail, return receipt <br /> requested, and shall be in a form prescribed by the Commission. Said <br /> notice shall specify the time and date of the hearing, shall describe <br /> the proposed activity and the location thereof and shall state where <br /> the application and plans may be examined by interested parties. The <br /> Commission and/or its Agent may require the applicant to notify ( in <br /> the same forementioned manner) additional property owners within <br /> three hundred (300) feet of the boundary of the property on which the <br /> work is proposed. If such additional notification is deemed <br /> necessary by the Commission, notice of such shall be provided to the <br /> applicant with the written notice of the time and date of the hearing <br /> for said notice of Intent. <br />
