waterways within the town. Further signs and markers may be placed at strategic <br /> locations throughout the waterways. <br /> §170=3. Enforcement; Violations and Penalties <br /> A. Unless otherwise specified, the provisions of this chapter as well as Chapter 90B shall be <br /> enforced by the Harbormaster and Assistant Harbormasters, and by—police officers <br /> empowered to patrol the waters of the Town of Mashpee. [Amended 19951 <br /> B. Whoever violates any of the provisions of this chapter and refused to obey the lawful and <br /> reasonable orders of those empowered to enforce same or resists them in the discharge of <br /> their duties shall be fined according to the fine schedule set forth in regulations <br /> promulgated by the Harbormaster and approved by the Board of Selectmen pursuant to <br /> Section 170-2 (A) of this chapter. (Mashpee Waterways Regulations, Mashpee Mooring <br /> Regulations and Mashpee Pond Ramp Regulations). Violation of this chapter may be <br /> enforced by non-criminal disposition pursuant to MGL Chapter 40 Section 21(D). <br /> [Amended 1995] <br /> §170-4. Speed <br /> A. Maximum Speed for watercraft is"Slow,No Wake" (Headway Speed): <br /> 1. during the period fronfone(1)hour after sunset to one (1)hour before sunrise, in <br /> any area of any fresh water waterway. <br /> 2. in posted areas <br /> 3. within one hundred fifty(150)feet of: <br /> (a) shore <br /> (b) bathers (also see Swim area) <br /> (c) vessels propelled by means other than machinery <br /> (d) vessels not underway(for example moored or anchored) <br /> (e) commercial docking or mooring areas <br /> (f) private docking or mooring areas <br /> 4. On the following bodies of tidal water: <br /> (a) Great River, except in any planing channel as may be posted in Upper <br /> Great River <br /> (b) Little River <br /> (c) Santuit River <br /> i <br /> (d) Mashpee River <br /> (e) Ockway River,except in any planing channel as may be posted <br /> (f) In the Mashpee part of Shoestring Bay and Simons Narrows <br /> 5. During conditions of low visibility <br /> B. A boat or personal watercraft operator within sight of a diver's flag shall proceed with <br /> caution and within a radius of one hundred (100) feet of such flag shall proceed at a <br /> speed not to exceed three(3)miles per hour.
