f- I Planning Board voted at the Public Hearing held on August 19, 1998 3 to 1 to approve Article 26. Motion passes unanimously at 7:40pm. Article 27 To see if the Town will vote to amend the zoning bylaw by amending Subsection 174-47.C.(1) as follows: In the first sentence, replace the phrase "and shall be filed at a regular meeting of the Board" with the phrase "and shall be filed with the Town Clerk". Replace the last sentence with the following: "After submission of the required materials to the Town Clerk, the applicant shall forthwith deliver to the Planning Board a copy of said materials, including the date and time of filing certified by the Town Clerk." or take any other action relating thereto. Submitted by Planning Board Explanation: The filing procedure for cluster subdivision special permits contained in the zoning bylaw is currently inconsistent with the requirements of Massachusetts General Laws, Chapter 40A, Section 9, which requires that all special permit applications be filed first with the Town Clerk and then transmitted to the special permit granting authority. (Our bylaw has the procedure reversed.) This article would correct that inconsistency. Motion made by Curtis Frye. Motion: I move Article 27 be approved as printed in the warrant with the exception of the phrase, "or take any other action related thereto." Planning Board voted at the Public Hearing held on August 19, 1998 4 to 0 for approval on Article 27. Motion passes unanimously at 7:42pm. Article 28 To see if the Town will vote to amend the Zoning Bylaw by amending Section 174-47 as follows: Amend Subsection 174-47.B.(10) to read "Each lot shall contain not less than ten thousand(10,000) square feet."
