October 4, 1999 <br /> Annual Town Meeting <br /> P <br /> Article 23 <br /> To see if the Town will vote to amend the zoning bylaw as follows: <br /> Replace the current wording of Subsection 174-26.B.(1)with the following: <br /> "(1) Notwithstanding the provisions of Subsection A, within any year the number of new dwelling <br /> units for which building permits may be issued shall not exceed 100. Said total shall not include <br /> any dwelling units exempted from the provisions of this section by Subsection C.below." <br /> Amend Subsection 174-26.C.(1) by replacing the phrase "Subsection A" in the first sentence with the <br /> phrase"this section"and adding after the phrase"developments approved prior to May 11, 1987,under <br /> an unexpired special permit which included a specific annual phasing schedule," in the first sentence <br /> the phrase "dwellings legally restricted to occupancy by persons aged 55 or over in conformance with <br /> Massachusetts General Laws and applicable regulations," <br /> I <br /> j <br /> with said amendments to take effect on January 1,2000, <br /> or take any other action relating thereto. <br /> Submitted by Planning Board <br /> Explanation: This article would reduce the number of building permits which may be issued annually <br /> from 2 1/2%of existing building stock(approximately 200 units in 1999)to 100,excluding permits for <br /> building within Open Space Incentive Development projects, projects legally restricted to occupancy <br /> by persons aged 55 or over, public housing developed by the Mashpee Housing Authority, up to 100 <br /> units of deed-restricted low- or moderate-income housing as defined by the Mass. Department of <br /> Housing and Community Development and projects that are exempted from this bylaw provision by the <br /> "grandfather" clause contained in the state Zoning Act. In 1998 there were 293 residential building <br /> permits issued in Mashpee,of which 178 were determined by the Building Inspector to be exempt from <br /> this bylaw by the state"grandfather"clause. <br /> Motion made by Selectman Taylor. <br /> Motion: I move Article 23 be approved as printed in the warrant with the exception of the phrase, "or <br /> take any other action relating thereto." <br /> Plannina Board voted at a Public Hearing held August 18,1999 4-0 for approval. <br /> Motion made to consider Articles 23 and 35 together at 9:31 P.M. <br /> Motion to amend passes at 9:47 P.M. <br /> Amended motion does not pass 70 to 112. 10:04 P.M. <br /> Motion to extend Town Fleeting passes 115 to 56 at 10:08 P.M. <br /> Motion made to reconsider original Article 23 motion at 10:09 P.M. <br /> Motion to reconsider original article passes at 10:10 P.M. <br /> Motion made to amend motion to read "within any year the number of new dwelling units for <br /> which building permits may be issued shall not exceed 90"passes at 10:11 P.M. <br /> Amended motion passes 134-26 at 10:14 P.M. <br /> RUE COPY, ATTE&T <br /> 25 <br /> WN CLERK OF MA PEE1 <br />
