Article 13 <br /> To see if the Town will vote that those parcels shown on the 2001 Mashpee Assessors' <br /> Maps as Map 62, Blocks 28 and 29 shall not be held for by the Town as conservation <br /> land; and further, vote that said parcels shall be transferred from the care and custody <br /> of the Tax.Collector for the purposes of sale, to the Board of Selectmen for purposes of <br /> sale to an entity or entities engaged in the development of affordable housing for sale or <br /> rental to persons of low or very low income within the meaning of the Housing Act of <br /> 1937, and qualifying for listing committee in the affordable housing inventory <br /> maintained by the Mass. Housing Appeals Board under G.L. Chapter 40B, with such <br /> transfer to be made subject to a permanent deed restriction, which may contain a <br /> reverter clause, permanently restricting the sale or resale price, or rental cost, of any <br /> homes or apartments constructed on said parcels to no more than that considered <br /> affordable for persons of low income as defined by the U.S. Department of Housing & <br /> Urban Development and qualified for continued listing in the above affordable housing <br /> inventory; and finally, to authorize the Board of Selectmen to convey such parcels for <br /> such affordable housing purposes, and to make use of other instrumentalities of the <br /> Town or other agencies and to enter into any agreements necessary, to effect the <br /> transfer of such land in accordance with this article, or take any other action relating <br /> thereto. <br /> Submitted by the Board of Selectmen <br /> Explanation: This article would authorize the Selectmen to transfer title to two lots <br /> located in Route 28 east of Orchard Road, previously taken by the Town for non- <br /> payment of taxes, to persons or agencies that would construct affordable homes or <br /> apartments. The lots total 17,500 square feet, and would be developed with the <br /> approval of the Board of Selectmen under the "Local Initiative Program" and G.L. <br /> Chapter 40B, as was done with a number of lots previously deeded by the Town to <br /> Habitat for Humanity. The lots would be permanently restricted for use for affordable <br /> housing and would be transferred to an agency or organization selected through a <br /> "Request for Proposals" process. <br /> Article 14 <br /> To see if the Town will vote to amend the zoning bylaw by replacing Subsection 174- <br /> 45.2B.(4) with the following: <br /> "(4) In addition to the Dimensional Requirements specified in §174-25E.(11), a twenty <br /> (20) foot vegetative buffer containing adequate screening given the character of the <br /> neighborhood and the intensity of the use shall be provided between adult <br /> entertainment uses and abutting commercial uses, if any." <br /> or take any other action relating thereto. <br /> Submitted by Planning Board <br /> Page 8 <br /> October 2002 Town Meeting <br />
