Explanation: This article would fix an error in the existing Zoning By-law by providing <br /> the correct reference to the Table of Use Regulations section for Adult Entertainment <br /> Uses, which is §174-25E.(11). The letter E had been left out. <br /> Article 15 <br /> To see if the Town will vote to amend the zoning bylaw by adding the following new <br /> definition to Section 174-3 before the definition for"Assisted Living Facility": <br /> "APPLICANT— The person who submits an application for a permit or variance <br /> approval and his administrators, executors, heirs, devisees, successors and assigns. The <br /> applicant must be owner of all land included in the submitted plan or proposal or any <br /> person who shows specific written and notarized authorization by the owner to submit <br /> the application and to speak for and bind the owner with regard to any representations <br /> regarding the property or the owner's intent, with regard to any agreements made with <br /> Town Boards as part of the permit or variance review and approval process and with <br /> regard to the owner's understanding of any conditions imposed upon the project as part <br /> of the Board's decision. Proof of ownership shall include a copy of the latest recorded <br /> deed or Land Court certificate as well as a copy of.the Mashpee Board of Assessors' <br /> current listing for the property. The applicant is considered a "party in interest" with <br /> regard to required public hearing and decision notices." <br /> or take any other action relating thereto. <br /> Submitted by Planning Board <br /> Explanation: This article would create a definition of "Applicant" specifying who has <br /> standing to appear before Town Boards for permits or variances under the Zoning By- <br /> law and what evidence is required to demonstrate such standing. <br /> Article 16 <br /> To see if the Town will vote to amend the zoning bylaw by replacing Subsection 174- <br /> 55C. with the following: <br /> "C. In an industrial or commercial district, one (1) freestanding sign is permitted on each <br /> lot, provided that it does not exceed (40) square feet in signboard area, does not <br /> exceed fifteen (15) feet in height and is not located closer than five (5) feet to any lot <br /> line or block a line of sight for pedestrian and traffic safety if so determined by the <br /> D.P.W. Director. The top edge of any such freestanding sign shall be not higher than <br /> Fifteen (15) feet vertical measure above the average level of the ground between the <br /> supports of each sign." <br /> or take any other action relating thereto. <br /> Submitted by Planning Board <br /> Page 9 <br /> October 2002 Town Meeting <br />
