Article 21 To see if the Town will vote to establish a Student Parking Fund Revolving Account in accordance with Massachusetts General Laws, Chapter 44, Section 53E 1/2 to which shall be credited parking fees collected by the School Department and from which expenditures, not to exceed $5,000 for lot maintenance services or other similar costs, may be made by the School Committee without further appropriation, or take any other action relating thereto. Submitted by the School Committee Explanation: In view of FY2005 budget cuts, the High School administrators and School Committee will institute a Student Parking Fee beginning in September 2004. It is hoped that even the small amount to be generated by the $55 per year fee for seniors and qualifying juniors can be used to offset parking lot maintenance and repairs, thus freeing funds in appropriation for educational purchases. Recommendation: Finance Committee does not recommend approval. Article 22 To see if the Town will vote to transfer to the Board of Selectmen and authorize the Board to convey to the United States of America an easement and right of way in, on, over and across parcel of real estate owned by the Town and identified as Tract No. 101E, as shown on the Plan entitled "Easement Plan on Land in Mashpee, MA Scale 1" _ 40', dated March 22, 2002, by Norwood Engineering Company, Inc. Consulting Engineers and Land Surveyors, Sheets No. 1 and 2 of 3", a copy of which is on file with the Office of the Town Manager, for the purposes of conducting environmental investigation and response activities, including any such work as may be necessary and incidental thereto, upon such terms and conditions as the Board of Selectmen may deem appropriate; to authorize the Board of Selectmen to prepare and execute any such instruments or other documents as may be necessary to effect the conveyance of said easement rightsr and, furthermore, to authorize the Board of Selectmen to petition the Massachusetts General Court pursuant to Article 97 of the Amendments to the Massachusetts Constitution for special legislation to authorize the transfer and change in use of the easement area within said Tract 101E, or take any other action relating thereto. Submitted by the Board of Selectmen Explanation: This article will authorize the conveyance of an easement and right of way over certain bogland and conservation land located off of Grafton Pocknett Road to the Department of the Army, New England District Corp. of Engineers, for the purposes of conducting environmental investigations and remediation activities with respect to a fuel spill at the Massachusetts Military Reservation. The proposed easement is to be conveyed pursuant to an Agreement between the Department of the Army and the Board of Selectmen dated January 26, 2004. Given the current public use of the subject property for conservation/agricultural purposes, the Town will be required to petition the General Court pursuant to Article 97 of the Amendments to the Massachusetts
