the Town of Mashpee exceeds the criteria of ten percent (10%) of the <br /> i <br /> housing units in existence as low or moderate income units based on <br /> the 1980 census, at the time the application was presented. <br /> 2. Taking into consideration the fact that the Town of <br /> Mashpee is located in a seasonably adjusted area, wherein the pop- <br /> ulation fluctuates according to the seasons, and taking into <br /> consideration that there are two thousand nine hundred and eighty-two <br /> (2,982) living units in Mashpee, of which only fifty percent (50%) <br /> are year-round, allowing for seasonal adjustment, the one hundred <br /> forty-nine (149) existing assisted units in the Town of Mashpee, meets <br /> the criteria of local need and under Section 20, is presumed to meet <br /> its committment for the region. <br /> 3. The applicant does not meet the standard of health and <br /> safety insofaras it is within the Compatible Use District 11A, as <br /> defined by the Otis Air Force Base Air Installation Compatible Air Zone <br /> .(AICUZ), wherein it was recommended by the Chief of Base Services in <br /> a letter from the Department of the Air Force, addressed to the Board <br /> of Appeals, that the proposed site is incompatible with the Air Force <br /> (AICUZ) plan, and is so situated that it is included within the glide <br /> path of the North eastern sector of the Otis Air Force Base and that <br /> to place two hundred (200) bedrooms within that prohibited zone would <br /> be detrimental to the health and safety of the individuals projected to <br /> be living there. <br /> 4. The Petitioner did not satisfy the Board with respect to <br /> its plan to provide for appropriate water quality. That no evidence was <br /> offered to satisfy the Board that the applicant could qualify with Title <br /> V of the Environmental Code, especially since it was testified that the <br /> nursing home personnel had alredy objected to the quality of water when <br /> a representative testified at a hearing concerning a new dump location. <br /> -2- <br />
