BOARD OF APPEALS Minutes - June 14, 1989 Page 2. <br />• Dale A. and Deborah J. Dougherty - Request a Special Permit under <br />Section 5.1 of the Zoning By-laws for permission to change or extend a <br />non -conforming structure in an R-5 Zoning District on property located <br />at 192 Ninigret Ave. (Map 65, Block 94) Mashpee, MA. <br />Members sitting: William Hanrahan, Cheryl Hawver, Richard Halpern <br />Mr. Govoni stepped down from the Board for the hearing. <br />Mr. Dougherty presentedplans for a proposed addition at the rear <br />of the building and the addition of a second story to the house. <br />James Mahoney, an abutter, commented that the addition would block <br />his view from the deck. Mr. Dougherty presented pictures taken in the <br />area and claimed that the tree .line would block views rather than the <br />proposed construction. <br />Leo Rafferty, an abutter, stated that he had no objections to the <br />plans. <br />There was discussion that two-story houses were consistent with <br />the neighborhood. Mr. Mahoney questioned if septic system would effect <br />his property and he was informed that the.Board of Health would address <br />any sanitary problems. <br />William Henchley, attorney, presented a petition signed by seven <br />abutters in favor of the petition. He also had a plan showing the lots <br />on the side of the street. Mr. Hanrahan read a statement that said <br />most of the homes were located too close to the lot lines. When a land <br />survey was done in September, 1988, it was discovered that an error <br />had been made on eight lots. Mr. Boyd confirmed that the eight lots <br />involved had discovered they had less land on one side than shown on <br />original plans. <br />Mr. Mahoney asked if Board would view the lots. The Board agreed. <br />Mr. Hanrahan moved to take the petition under advisement. Mr. <br />Halpern seconded. All agreed. <br />Paul W. and Carol Jacobson - (Owner of record: Paul W. Jacobson <br />and Yvonne A. Cocks) - Request a Special Permit under Section 5.1 of <br />the Zoning By-laws for permission to change or extend a non -conforming <br />structure in an R-5 Zoning District on property located at 196 Ninigret <br />Ave. (Map 65, Block 95) Mashpee, MA. <br />Members sitting: William Hanrahan, Cheryl Hawver, Richard Halpern <br />Attorney William Henchley presented the petition. He reviewed <br />the September, 1988 plans of the eight lots which had a change in side <br />• lot lines from the original surveys. He explained that the owner had <br />obtained a building permit for an addition to a garage. Douglas Boyd <br />stated that there had been an old foundation but he advised Mr. Jacobson <br />to stop construction when the change in the lot lines was discovered. <br />
