• MASHPEE BOARD OF APPEALS <br />Minutes <br />July 19, 1989 <br />The Mashpee Board of Appeals held a meeting at the Mashpee Town Hall <br />on Wednesday, July 19, 1989 at 7:30 P.M. Board members present and <br />acting throughout were: Cheryl A. Hawver, Michael A. Makunas, Edward M. <br />Govoni, Richard E. Halpern and John J. Friel. Douglas S. Boyd, Building <br />Inspector, was in attendance. <br />Leonard Needleman - (Owners of record: Leonard and Deborah Needleman) <br />Request a Variance under Section 7.4 of the Land Space Requirements for <br />permission to vary the side line set -backs in an R-3 zoning district on <br />property located at 14 Keel Way (Map 120, Block 131) Mashpee, MA. <br />Members sitting: Cheryl A. Hawver, Michael A. Makunas, Richard E. Halpern <br />Attorney J. Carter represented the applicant. He informed the Board <br />that Mr. Needleman had earlier applied for a Special Permit to build a <br />two -car garage and had been advised by the Board that a Variance application <br />was more appropriate. He reviewed the plans of the pie -shaped lot located <br />on a cul-de-sac and stated that the topography of the lot presented a <br />• hardship in the placement of a garage. He explained to the Board that the <br />neighboring lots are similarly shaped and many have required variances on <br />the side line set -backs. No comments were received from abutters. <br />Mr. Makunas moved to grant the Variance allowing for a 5 foot setback <br />on the southwesterly lot line. Mr. Halpern seconded. All agreed. The Board <br />requested a new set of signed certified plans. <br />Hall Oil Company - (Owner of record: Fields Point Limited Partnership) <br />Requests a Special Permit under Section 6.3.E.8 of the Land Use Regulations <br />for permission to sell LP gas for grill tank refills in a C-1 zoning <br />district at Pine Tree Corner (Map 74, Block 16) Mashpee, MA. <br />Members sitting: Cheryl A. Hawver, Michael A. Makunas, Edward M. Govoni <br />Mr. P. Muniz, General Manager of Hall Oil Co., represented the petition. <br />He informed the Board that the company has a 1,000 gallon propane gas tank <br />on the premises and that the primary business was the refill of grill tanks <br />and, occasionally, tanks for recreational vehicles. He stated that they <br />surpass all of the State and Federal safety requirements for the storage <br />of propane gas. <br />Mr. Makunas questioned the association of the refill store with the <br />Mashpee Commons retail store for grill equipment. Mr. Muniz explained <br />that Hall Oil Co. is the parent company for -both stores. Mr. Makunas <br />stated that the advertising he had seen implied that tank refills were <br />• available at Mashpee Commons. Mr. Muniz replied that he had difficulty <br />with the Pennysaver advertising. He said advertising omitted the phrase <br />"coming soon" for the operation of the refill store. <br />
