Board of Appeals Minutes August 9, 1989 Page 2. <br />e <br />• In January of 1988 there remain 20 lots that have not been sold. <br />So the Board extended for 6 months. Now there are 6 lots left. <br />During the extension period 14 lots were built upon. Now they <br />have 6 remaining and it was determined by Town Counsel and the" <br />Board of Appeals that it would be necessary to reapply rather <br />than seek fui:ther extensions.For.this reason applications have been <br />filed for each of these 6 lots. Situation remains exactly as was <br />the case at the time the original.variances were granted on 45 <br />lots in 1986. And Mr. Anderson respectfully requests that the <br />Board of Appeals grant a release in each case.to allow these to be <br />classified as buildable lots. <br />John Grassetti (abutter) questioned the grandfather clause and <br />whether it was acre zoning or � acre zoning. <br />Doug Boyd.explained that they could build.on a � acre provided <br />the Board of Appeals states that they -can. It is acre zoning <br />unless the Board states its k acre zoning. <br />John Grassetti stated that he feels it should be acre zoning. <br />Mr. Anderson explained that.they are not building, they are <br />under a conditional Purchase and Sale agreement to the same.builder <br />which he believes is one of the Dacy companies.: <br />• John Friel made a motion to vote to approve this request for <br />variances for all 6 ofthe main lots. Richard Halpern seconded. <br />All agreed. <br />Robert Hansen - (Owner of record: Robert H. and Janet K. <br />Hansen) Requests a Variance under Section 7.7 ofthe Land Space <br />Requirements for permission to construct an addition--:, deck and <br />in -ground poll within 50 feet of wetlands in an r-3 zoning district <br />on property located at 31 Keel Way (Map 120, Block 134) Mashpee, MA. <br />Members sitting: Cheryl Hawver, Richard Halpern, John Friel <br />Susan Asnus from Warwich Associates represented the applicant. <br />Plans were presented. As shown they are proposing to construct <br />and maintain an addition as well as a deck and in-ground.pool. <br />As the plan sits now, the.only portion,.of that, that is within <br />the 50 feet is.a small portion of the deck, and some of,the <br />swimming pool. Photographs were presented. Ms...Ansnus,- explained <br />that the lot is a very well treed lot. The top of the bank is <br />basically a line of shubbery, so in reality they are going to be <br />43 feet from the line. Ms. Asnus stated that they do not believe <br />that this will have any adverse effects on the resource areas and <br />they are requesting the variance from this set back requirement. <br />• <br />
