Frongillo - Request a Special Permit <br />under Section 5.1 of the Zoning By-laws to allow for the construction <br />of a swimming pool in an R-3 zoning district on property located <br />at 42 Seconsett Island Road (Map 119, Block 30) Mashpee, MA. <br />Members sitting: Cheryl Hawver, Michael Makunas, William <br />Hanrahan <br />Presented by Harry Corbett Engineer. This house was bought <br />in 1988. It was actually built in 1970-71 period which at that <br />time was in a current R-100 or R-125. It required side yards of <br />15' and the rear set back of 10'. So at the time the shed was <br />built it was within the set back requirements. They would now <br />like to build an inground pool 18' by 361. It is shown on the <br />plan with the location of the pool in line with the existing <br />shed on the rear set back 11'1" from the�back property line and <br />they are still holding 16' from the side line. The requirement is <br />still 151. So what they are asking for is a variance on the <br />pool and they will line the pool up with the existing shed. They <br />do not feel as though it is anything detrimental to the neighbor- <br />hood. A fence around the pool is also proposed. The pavement <br />around the pool will be brick. <br />Cheryl Hawver read a letter from Joel A Carter, abutter, <br />who is in favor of the pool. <br />• Bob Sherman, conservation agent sent a memo stating that he <br />reviewed the plans and determined that the Conservation Commission <br />has no jurisdiction if the pool is more than 100' from the water. <br />Mr. Makunas asked Doug Boyd what he considered the edge of <br />a pool under structure. <br />Mr. Boyd stated that there are two different schools of thought <br />He feels that a pool in some cases if it is down low enough is not <br />a structure. Joe Reardon agrees. Leslie feels the pool and the <br />deck has to meet the set back from the edge of the pool. <br />Mr. Makunas moved to grant the Special Permit. <br />William Hanrahan seconded. <br />All agreed. <br />Bernard Kelly - (Owner of record: Christian Kim David) - <br />Reguests a Special Permit under Section 6.3.H.6 of the Land Use <br />Regulations to allow for a jewelry design studio workshop in an <br />R-3 zoning district on property located at 609 Great Neck Road South <br />(Map 104, Block 28) Mashpee, MA. <br />Members sitting: Cheryl Hawver, William Hanrahan, Michael <br />.
