Board of Appeals Minutes - October 11, 1989 Page 4. <br />Ben Lofchie, President of the S.C.C.A., said that letters had been <br />• sent to all members explaining the proposed dock and asking if they <br />approved or disapproved. The replies were all favorable and Mr. Umina <br />was the first person to raise any objections. He said most residents <br />now use the Town boat ramp. <br />Mr. Umina replied that he did not remember getting a letter and he <br />would like to see the letters from residents in favor of the project. <br />He said that the only reason the S.C.C.A. is using this location is that <br />they had some problems with the Shellfish Commission. They are looking <br />to alleviate these problems by taking a ramp that people use. <br />Mr. Govoni asked if owners had deeded rights and Mr. Gauthier replied <br />that they have rights to the reserve land but most of the deeds do not <br />mention the use of the open space. <br />Mr. Gauthier said that the Association had voted unanimously in favor <br />of the dock at their annual meeting in July. <br />Mr. Umina stated that he disagreed that the Town boat ramp is better <br />than the old ramp. He also said that the Association cannot take away <br />the right of any one to use the property. He commented that people without <br />moorings may want to use the ramp. <br />Mr. Govoni asked why this location was chosen. Mr. Umina replied <br />that they were having a problem with the Shellfish Warden because the <br />previous floating dock was interfering with the shellfish. <br />• Mr. Friel asked the Shellfish Constable to explain the problems. <br />Mr. Somerville said they had a floating structure before and there <br />was a question on whether it had to go through Conservation since they <br />had never applied to Conservation. He said he had never said anything <br />to Conservation about the structure. He felt it was a floating.pier and <br />should go through the same process as anyone else. Town Counsel has <br />said that it does have to go through Conservation. He said the location <br />of the pier came up at a Conservation hearing but Mr. Somerville did not <br />make any comment on the location. He had no objection to the structure <br />as presented. He said area is difficult to assess and he did not find <br />significant quahog resources. He did not think that area where boats <br />would be landing would be a problem. <br />Mr. Gauthier stated that the Association wanted to comply with the <br />Chapter 91 and D.E.P. regulations at the same time. <br />Ms. Hawver asked Harbormaster Chester Koblinsky for comments. He <br />said he was highly in favor of the dock and of community docks. <br />Mr. Umina said he was in favor of a dock but not in that location. <br />Ms. Denise Sullivan, a neighbor, asked if Board was aware of another <br />dock application by the Association. <br />• <br />
