i <br />MASHPEE BOARD OF APPEALS <br />MINUTES <br />November 29, 1989 <br />The Mashpee Board of Appeals held a meeting at the Mashpee Town <br />Hall on Wednesday, November 29,'1989 at 7:30 p.m. Board members <br />present and acting throughout were: Michael A. Makunas, William J. <br />Hanrahan, Richard E. Halpern and John J. Friel. Douglas S. Boyd, <br />Building Inspector, was in attendance. Mr. Makunas was acting Chairman. <br />Richard and Miriam Coffman - Request a Special Permit under <br />Sections 5.1 and 6.2 of the Zoning By-laws and/or a Variance <br />under Section 7.7 of the Land Space Requirements for permission <br />to build an addition on sonar tubes in an R-3 zoning district on <br />property located at 105 Whippoorwill Circle (Map 125, Block 150) <br />Mashpee, MA. (Continued from November 8, 1989). <br />Members sitting: M. Makunas, W. Hanrahan, R. Halpern <br />Attorney William Henchy represented the applicants. He reviewed <br />the site plan and explained that the lot bordered the Great River and <br />was surrounded by a sea wall. The owners propose to add an extension <br />4' in a pentagon shape. He said that the retaining wall has been <br />designated as the top of the coastal bank and portions of the proposed <br />• addition will be within the 50' setback as are portions of the <br />existing structure. He explained that the addition will 6e supported <br />by sonar tubes which will be hand dug. <br />Mario DiGregorio, Wetland Consultant from Sabatia, presented the <br />Board with an Environmental Impact report on the site. He stated <br />that there would be no impact on the site's flood storage capacity <br />and that the hand labor proposed should insure no adverse effects <br />to the bank's stability. He said all roof runoff will be contained <br />on-site. He said that the Massachusetts Natural Heritage and <br />Endangered Special Program had approved the plans. <br />Mr. Henchy reviewed a photo of the area showing the adjoining lots. <br />John Malloy, an abutter, reviewed the plans and explained that he <br />owned the adjoining lot and the lot across the street. He said he <br />had wanted to know exactly what was proposed. Mr. Makunas reviewed <br />the plans with Mr. Malloy and Mr. Henchy said he would give him a copy <br />of them. <br />Mr. Coffman explained that the addition would allow for a larger <br />bedroom. 1. <br />Mr. Halpern asked if area was in A.C.E.C. and Mr. Coffman replied <br />that it was not. Mr. Coffman informed the Board that the wall had <br />. been built in 1972 and he had reinforced it with 44 telephone poles <br />on the inside. There were no comments from Conservation or Shellfish <br />Constable. Mr. Malloy said he had concerns since he has a septic system <br />approved for his lot and that he understood the well on the Coffman lot <br />is only 6' from his lot line.
