William J. and Gertrude M. Deery - Request a Special permit under Section 174-28�I.9 of the Zoning By-laws for permission to move and reconsruct an existing pier in an R-3 zoning district on property located at 122 Captain's Rota (Map 96, Block 19) Mashpee, Ma. Members sitting: William Hanrahan, Michael Makunas, Cheryl Hawver Represented by Mr. Greg Taylor. fie explained that Mr: Deery had owned the dock for 20 years and it -has not been permitbd Therefore he is requesting this from the Board of Appeals. He has owned the property since 1961 and has found that most of his dock was not on his property, so he wants to move the dock.. Paul Somerville , submitted a memo stating that he did not feel as though this will cause a substantial disruption degradation of the marine or coastal environment. Mr. Hanrahan moved to grant as requested with the excepti.on that the proposed steps be eliminated from the plan. Mr. Makunas seconded. All agreed. Majorie Lipkin asked what the spacing was between the two docks in the water. The spacing is 25' from the 3" pipe. Mr. Lelito stated that it is 33' from the proposed walkway to Mrs. Lipkins float. From the 3" pipe which is an associated structure is 251. Mrs. Lipkin explained tht .-he has been told once someone gets the walkway anyone can build a dock. Mr. Lelito stated they are not proposing_a dock. He stated that the depth of the water is approxiamatley 12" by the proposed walkway, Mr. Makunas moved that the board take under advisement.
