Board of Appeals Minutes - February 14, 1990 Page 9. <br />Leon Rosenberg - (Owner of record: A. Eugene and Corrine M. Stillman) <br />Request a Variance under Section 174-31 of the Zoning By-laws for <br />permission to vary the maximum lot coverage requirement on property <br />located in an R-3 zoning district at 127 Popponesset Island Road <br />(Map 112, Block 18) Mashpee, MA. <br />Members sitting: M. Makunas, W. Hanrahan, R. Halpern <br />Engineer Christopher Costa represented the Applicant. He presented plans <br />for a house addition and a two -car garage. He explained that the house <br />has only basement crawl space and the owner required additional storage <br />space. The proposed lot coverage would be 23%. <br />Attorney Kevin Kirrane, representing a direct abutter, Alfred White, <br />informed the Board that his client was opposed to the Variance application. <br />He presented a brief to the Board. He stated that he did not consider there <br />was any hardship in this case. He questioned the use of a 24' x 42' <br />garage and said it was considerably larger than many homes. He said the <br />proposed addition would bring the dwelling within 5' of the wetlands and <br />asked if there should not be application for variance relief on setback <br />from the wetlands. <br />Mr. Hanrahan read a letter from Attorney Stephen M. Politi, an abutter, <br />saying he was in strong opposition to the application. <br />There was discussion on the need for a variance from the wetlands. <br />Mr. Hanrahan moved to deny the application on the basis that no hardship <br />exists. Mr. Halpern seconded. All agreed. <br />Debra Orlando - (Owner of record: John E. and Phyllis J. Toner) - <br />Requests a Variance under Section 174-31 of the Zoning By-laws for <br />permission to vary the side line setback in an R-3 zoning district on <br />property located at 19 Pinecrest Avenue (Map 49, Block 161) Mashpee, MA. <br />Members sitting: M. Makunas, W. Hanrahan, J. Friel <br />Christopher Costa represented the applicant. He explained that a new <br />foundation had been poured resulting in it being 11" too close to the <br />property line on the back corner and 7" too close on front. He said <br />stakes had been properly laid out but had been moved before the pouring. <br />Matthew Simpson, a direct abutter, said he had notice stakes had been moved <br />and thought that whoever poured the foundation had changed the sta,(es. <br />Mr. Makunas asked Mr. Simpson if he was objecting. He replied that he did <br />not have a problem with it. Mr. Orlando, the applicant's father, said <br />they would have landscaping designed to hide the foundation. <br />Mr. Friel moved to grant a Variance of 1.5' on the Southeasterly side set back. <br />Mr. Hanrahan seconded. All agreed. <br />Mr. Hanrahan stepped down from the Board and left the room. Mr. <br />William Covell addres�ed:he Board for general discussion of affordable housing. <br />Board members discussed requesting a joint meeting with the Selectmen and <br />Planning Board to discuss zoning issues. John Friel moved to accept minutes <br />of December 27, 1989 and January 10 and 24, 1990. Mr. Halpern seconded. All <br />agreed. John Friel moved to adjourn. Mr. Halpern seconded.
