BOARD OF APPEALS Minutes - March 14, 1990 5. <br />• William F. Hennessey - (Owner of record: Lawrence Nadzeika TR) - <br />Requests a Variance under Section 174-31 of the Zoning By-laws for <br />permission to vary the set -back requirements to allow for the construction <br />of a garage in an R-5 zoning district on property located at 17 Fox Hill <br />Road (Map 21, Block 74) Mashpee, MA. <br />Members present: C. Hawver, M. Makunas, J. Friel, R. Halpern <br />Mr. Hennessey informed the Board that he proposed to build a garage <br />at the side of his property abutting common land. He stated that one <br />corner of the garage would come to within 3' of the lot line. <br />John Sirocco, a direct abutter to the common land, said he had <br />no objections. <br />Mr. Makunas moved to grant the Variance as requested. Mr. Friel <br />.:seconded. All agreed. <br />Marjory Gordon (continued from earlier in evening) <br />Ms. Gordon returned with pictures of the shed and area proposed for <br />the storage cabinet. Mr. Makunas moved to grant the Variance. Mr. <br />Halpern seconded. All agreed. <br />Ms. Hawver announced a 5 -minute recess <br />DISCUSSION - Southport <br />Attorney Michael Dunning explained that the owners of Southport had <br />agreed to turn over 13 acres of land to the Town and that the holder of <br />the mortgage had now released the 13 acres. He presented the release <br />to the Board. <br />There was a discussion of the financing of the project and <br />Mr. Dunning explained that the Bank of Boson is taking over as the <br />lead bank. He explained that when Resolution Trust took over Citibank <br />they assumed their assets and liabilities and are bound by the loan . <br />document. <br />Mr. Ron Bonvie of Southport informed the Board that he is working <br />to finish the amenity center instead of the units and Mr. Dunning <br />requested the Board to allow the 90 -day extension permitted in the <br />earlier decision. <br />Mr. Makunas moved to grant the extension. Mr. Friel seconded. <br />All agreed. <br />Other Business <br />Mr. Friel moved to request a copy of the Master Plan of Mashpee from <br />the Town Planner. Mr. Halpern seconded. All agreed. <br />Mr. Makunas suggested that the Board submit a litter to all <br />Departments requesting input on the Deer Crossing permit. All agreed. <br />Mr. Halpern moved to adjourn at 10:10 p.m. Mr. Friel seconded. All agreed. <br />Elinor Walsh <br />
