MASHPEE BOARD OF APPEALS <br />VMinutes <br />Wednesday, May 23, 1990 <br />The Mashpee Board of Appeals held a meeting at 7:39 p.m. on <br />Wednesday, May 23, 1990 at the Mashpee Town Hall. Board members <br />present and acting throughout were Cheryl A. Hawver, William J. <br />Hanrahan, John J. Friel, Edward M. Govoni and Richard E. Halpern. <br />Member Michael A. Makunas arrived at 7:45 p.m. Building Inspector <br />Douglas S..Boyd was in attendance. <br />Florence A. Wall (Owner of record: Geoffrey T. Wall) - Requests <br />a Special Permit under Section 174-17 of the Zoning By-laws for <br />permission to change.and expand a non -conforming structure in an <br />R-5 zoning district on property located at 146 Ninigret Avenue <br />(Map 65, Block 79) Mashpee, MA. <br />Florence A. Wall - (Owner of record: Geoffrey T. Wall) - Requests <br />a Variance under Sections 174-28A and 174-31 of the Land Space Requirements <br />for permission to vary the setbacks and lot coverage in an R-5 zoning <br />district on property located at 146 Ninigret Avenue (Map 65, Block 79) <br />Mashpee, MA. <br />Members sitting: C. Hawver, W. Hanrahan, E. Govoni <br />• Engineer Charles.Spohr represented the applicant. He presented <br />revised plans to the Board reducing the lot coverage to 20.12% and <br />explained that the Board had earlier denied without prejudice a plan <br />for 24% lot coverage. Mr. Hanrahan questioned if a tool shed on the <br />property had been removed and Mr. Spohr replied that it had been <br />removed on May 10, 1989 and explained the detailed lot coverage <br />calculations. <br />Bob Spousta, an abutter, questioned the side -line setback <br />dimensions on the plan. Mr. Halpern explained that the lot is <br />bordered by three streets and the current by-laws require a 40' <br />setback from all streets. He said that the engineer included it <br />on the plan for reference only. Mr. Hanrahan explained that the <br />house is a pre-existing non -conforming structure and the setbacks <br />are established by the structure. <br />Mr. Hanrahan moved to grant the Special Permit and the Variance <br />since the plan represented an improvement with the removal of the <br />encroaching structures and the percent of lot coverage increase <br />requested is minor. Mr. Govoni seconded. All agreed. <br />• <br />
