Mashpee Board of Appeals Minutes May 23, 1990 3. <br />4 Discussion <br />1.. Robert Mc Nutt. Mr. McNutt reviewed the Lindsley decision from <br />the Board denying without prejudice the application for a Special Permit <br />to sell used cars at the Merry Meadow Shopping Center. He'stated that <br />the request for parking spaces had been deleted from the application. <br />He said that Mr. Lindsley now wants an office only since he sells <br />wholesale. He asked the Board to give him more specific information. <br />Mr. Hanrahan suggested he reapply without the parking request. <br />Mr. McNutt said Mr. Lindsley also sells computers with programs for <br />auto repair shops. He said the last use of the property was a design <br />studio. Mr. Makunas questioned,if a permit was needed. <br />Mr. Halpern asked if Mr. McNutt intended to clean up the rear of <br />the shopping center and Mr. McNutt replied that he had a problem with <br />large trucks and with drainage at the rear. Mr. Makunas stated that <br />an abutter had commented after the hearing and his concerns were not <br />considered by the Board in the decision. <br />Mr. McNutt showed the Board his original permit issued on <br />November 11, 1972 and Board members questioned if the original permit <br />allows the use. <br />Ms. Hawver directed the secretary to review the permit with Town <br />Counsel for an opinion on allowed uses. <br />2. Kevin M. Kirrane. Letter regarding request for an extension <br />of Special Permit of Melvin and Marcella Bradshaw. <br />Mr. Halpern reviewed the Bradshaw applications and explained that <br />the Board of Appeals had granted a 45' dock which Conservation had <br />denied. The Bradshaws had reapplied for a 70' dock which the Board <br />of Appeals had denied. The secretary read a legal opinion from <br />Town Counsel stating that a public hearing would have to be held <br />to prove "just cause" for extending the permit. All six Board members <br />voted unanimously to advise Mr. Kirrane that he would have to file <br />a new application before the expiration date of the original permit. <br />3. Ruth Ann Gould. A letter was received from Ruth Ann Gould, <br />Property Manager of P. F. O'Connor Lumber requesting a six month <br />extension of a Variance. The Board reviewed the law.from Chapter 40A <br />which allows for an extension. <br />Mr: Hanrahan moved to grant the six month extension. Mr. Govoni <br />seconded. Ms. Hawver made the vote unanimous. <br />4. Ron S. Jansson. Letter requesting addition of renewal phrase <br />in decision on Edward R. Wasil's special permit. The renewal right had <br />been included in the legal notice and he requested it be repeated in the <br />conditions. <br />• Mr. Hanrahan moved to grant a minor modification of the Special Permit, <br />Mr. Govoni seconded. Ms. Hawver made the vote unanimous. <br />
