Board of Appeals August.22, 1990 7 <br />All agreed. <br />John A. Sullivan: Requests a Variance under Section 174.31 <br />of the Zoning By-laws for permission to vary the setbacks in an <br />R-5 zoning district on property located at 31 Birch Way (Map 27, <br />Block 86) Mashpee, MA. <br />Members sitting: C. Hawver, M. Makunas, W. Hanrahan <br />Attorney Kevin Kir•rane represented the applicant. He <br />informed the Board that the property was being sold when it was <br />discovered that the house had been built too close to the lot <br />line. Mr. Makunas moved to grant the Variance based on plans by <br />Des Laurier•s Engineers dated July 18, 1990. The Variance allows <br />for, a 10.99 side setback from the back deck and an 8.18' setback <br />from the side deck. Mr. Hanrahan second. All agreed. <br />Minutes: Mr. Makunas moved to accept the minutes of July <br />11 and July 25, 1990. Mr. Hanrahan seconded. All agreed. <br />Zoning Article: There was discussion of the zoning article <br />restricting the months, in which Special Permits fordocks could <br />be filed. Mr. Makunas moved to approve the article provided it <br />is also sponsored by other Town Boards. Mr. Hanrahan seconded. <br />All agreed. * ', <br />Mr. Hanrahan moved to adjourn at 11 F.M.
