TOWN OF MASHPEE <br />• Board of Appeals <br />Minutes <br />September 5, 1990 <br />The Mashpee Board of Appeals held a meeting on Wednesday, <br />September 5, 1990 at 7:30 P.M. at the Mashpee Town Hall. Board <br />members present and acting throughout were: Cheryl A. Hawver, Chairman; <br />William J. Hanrahan,'Clerk; John J. Friel and B. Thomas Christian, <br />Associate Members. Michael A. Makunas, Vice -Chairman, and Edward M. <br />Govoni, Associate Members were present for all hearings except <br />151 Johns Pond Realty Trust. <br />Anthony J. Benison - Requests a Special Permit under Section 174-17 <br />of the Zoning By-laws for permission to expand a non -conforming structure <br />with the construction of decks and walkway in an R-3 zoning district on <br />property located at 16 Elliot Road (Map 117, Block 136) Mashpee, MA. <br />Anthony J. Benison - Requests a Variance under Section 174-31 of <br />the Zoning By-laws for permission to vary the setbacks in an R-3 zoning <br />district on property located at 16 Elliot Road (Map 117, Block 136) <br />Mashpee, MA. <br />• Members sitting: C. Hawver, M. Makunas, W. Hanrahan <br />Mr. Benison informed the Board that his attorney was detained and <br />asked for a continuance until later in the evening. Mr. Hanrahan moved <br />to grant the continuance. Mr. Makunas seconded. All agreed. <br />Forward Development - There was discussion of the Appeal received <br />from Forward Development appealing the decision of the Board of Selectmen <br />to refer their project to the Cape Cod Commission. Mr. Makunas informed <br />the Board that Town Counsel had ruled that the Board of Appeals has no <br />jurisdiction in this matter. Mr. Makunas moved to decline to hear the <br />appeal. Mr. Hanrahan seconded. All agreed. <br />Ms. Hawver declared a recess until 8:00 P.M. <br />151 Johns Pond Realty Trust and James Circle Realty Trust - Request <br />a Comprehensive Permit under Massachusetts General Laws, Chapter 40B and <br />Chapter 774. for permission to construct 23 single family homes in an <br />R-5 zoning district on property located on James Circle (Map 71, Blocks <br />150 to 163) Mashpee, MA. (Owners of record: Stage Development Inc. <br />and Bodfish Farms Inc.) <br />Mr. Makunas and Mr. Govoni stepped down from the Board for this <br />hearing. <br />• Members present: C. Hawver, W.
