Board of Appeals Minutes - September 12, 1990 3. <br />Mr. Storrs stated that he had a preliminary discussion with the <br />Planning Board on the 151 project and agreed that it must be referred <br />to the Cape Cod Commission. He said he would expect several meetings <br />to review the plans. <br />Mr. Makunas explained that the Board would refer the project <br />to the Cape Cod Commission and continue the hearing until after a <br />decision is received from the Commission. He said the Board would <br />request a 65 -day extension in the hearing calendar so that the Board <br />of Appeals could again advertise when the Commission decision was <br />received. <br />Mr. Storrs presented the Board with a request for a 65 -day <br />extension in the hearing calendar after receipt of the decision of <br />the Cape Cod Commission. <br />Mr. Friel moved to accept the extension. Mr. Govoni seconded. <br />All agreed. <br />Mr. Friel moved to refer the application to the Cape Cod Commission <br />and to continue the hearing until receipt of the decision of the Commission. <br />Mr. Govoni seconded. All agreed. <br />Mr. Storrs asked for discussion time for informal hearings on the <br />project while the Commission is reviewing it. <br />• Mark Eynation - Requests a Variance from Section 174-31 of the <br />Zoning By-laws for permission to vary the setbacks and lot coverage <br />requirements in an R-3 zoning district on property located at <br />51 Uncle Edwards Road (Map 117, Block 221) Mashpee, MA. (Owner of <br />record: B. Kenneth and Ruth H. Eynation). <br />Mr. Friel stepped down from the Board for this hearing. <br />Members sitting: M. Makunas, E. Govoni, T. Christian <br />John Slavinsky of Cape & Islands Surveying represented the <br />applicant. He explained that the lot was created in 1962 when the <br />zoning requirement was 20' from the street and 7}' from side lines. <br />He asked if he needed a Variance. <br />He presented plans for a proposed house on a corner lot 25' from <br />one street and 21' from the other street and 8' from side line. <br />Mr. Govoni asked what front setbacks were in the area and Mr. Boyd <br />replied that most homes were 25'. Mr. Boyd said a Special Permit would <br />be the proper application. Mr. Makunas discussed hardship requirements <br />on variances. <br />Pauline Ounjian, a direct abutter, said her home, built in 1973, <br />conformed to the 15' side set backs and 25' front setback and said she <br />objected to the 8' side line setback. <br />r] <br />
