Board of Appeals <br />Mark Eynation (continued) <br />Minutes - September 12, 1990 <br />4. <br />Claire Friel, an abutter, said that most of the lots were 6,500 sf <br />in the area and Mr. Makunas explained that the lot in question was <br />7,500 sf. Ms. Friel said that a 26'x 46'house is out of character with <br />the neighborhood and allowing an 8' side line setback would jeopardize <br />the value of the adjoining property. She suggested the applicant should <br />rethink the size of the house and conform to the community. <br />Mr. Govoni suggested house could be moved closer to the paper <br />road. Kenneth Eynation, brother of the applicant, explained that <br />a room on the first floor was being planned for his mother but he <br />thought house could be moved closer to the paper road. <br />Mr. Slavinsky submitted a request to withdraw. <br />Mr. Govoni moved to accept the withdrawal. Mr. Christian seconded. <br />All agreed. <br />Panayiotis Zafiropoulos - Requests a Special Permit under Section 174.17 <br />of the Zoning By-laws for permission to expand a non -conforming structure <br />with a house addition and deck in an R-3 zoning district on property <br />located at 39 Fiddler Crab Lane (Map 105, Block 104) Mashpee, MA. <br />.Panayiotis Zafiropoulos - Requests a Variance from Section 174-31 <br />of the Zoning By-laws for permission to vary the setbacks and lot <br />coverage requirements in an R-3 zoning district on property located at <br />39 Fiddler Crab Lane (Map 105, Block 104) Mashpee, MA. <br />Members sitting: M. Makunas, J. Friel, T. Christian <br />Architect Mark Marinaccio represented the applicant. Mr. Boyd <br />explained that this lot was thought to have been included in the New <br />Seabury permit for zero lot line setbacks and it was learned it was <br />not included. Mr. Marinaccio explained owner was planning renovations <br />and had a proposed front addition and deck and a proposed side deck. <br />The side setback would be 8'4". He said existing condition of front <br />steps created a hazard. <br />William Levine, a direct abutter, objected to the side deck and <br />presented letters from other abutters objecting to the petition. <br />Mr. Govoni explained that the house without the side deck would conform <br />to the neighborhood setbacks. Mr. Marinaccio said he thought owner would <br />be willing to eliminate deck and have a patio or walkway. Mr. Marinaccio <br />submitted a request for withdrawal without prejudice. <br />Mr. Friel moved to accept the withdrawal. Mr. Christian seconded. <br />All agreed. <br />Hamurco Associates - Mr. Friel moved to extend the Hamurco <br />Variances for six months. Mr. Govoni seconded. All agreed. <br />Minutes - Mr. Friel moved to accept the minutes of August 22, 1990. <br />Mr. Govoni seconded. All agreed. <br />Mr. Friel moved to adjourn at 9:35 P.M.
