MASHPEE BOARD OF APPEALS Minutes Wednesday, October 24, 1990 The Mashpee Board of Appeals held a meeting at 7:30 p.m. on Wednesday, October 24, 1990 at the Mashpee Town Hall. Board members present and acting throughout were: Cheryl A. Hawver, William J. Hanrahan, John J. Friel and B. Thomas Christian. Edward M. Govoni stepped down from the Board for the hearing on James Circle Realty Trust and was present for the other hearings. Michael A. Makunas was absent from the hearing on James Circle Realty Trust and was present for the other hearings. Building Inspector Douglas S. Boyd was in attendance. Ms. Hawver called the meeting to order at 7:35 p.m. James Circle Realty Trust: (continued from September 5, 1990) Members present: C. Hawver, W. Hanrahan, J. Friel, T. Christian Attorney Robert Mills represented the applicant and introduced other representatives: Michael Princi, attorney, Judith Barnet, consultant and owner Joseph deMartino. • Attorney Mills reviewed some of the issues raised by the Fire Department and the Board of Health. He said they had now presented topographic plans to the Board of Health. He also said that he'will be meeting with the Conservation Agent to review the wetlands and kettleholes. He stated that there has been illegal dumping on the site -- a hot water heater and a car and Mr. DeMartino was getting estimates for removal. He discussed the costs of providing water -- $1,700 for Town water and $1,350 for private wells and said Town water would not be available until July of 1991. He said they would be willing to connect to Town water if it were available prior to July of 1991, preferably by December, 1990 or January, 1991. Stephen Greelish, Chairman of the Board of Health, stated that the Board of Health has some problems with the 21E report done by Arlene Wilson Associates in 1989. He said no water samples or soil samples were done, the 21E had not picked up the dumping in the kettle holes and said these issues had to be addressed. Mr. Hanrahan questioned any influence from the plumes and Mr. Greelish replied that eventually there might be evidence of the plumes in the area served by the private wells. He said that the Board of Health felt they could relax the requirement of the 21E providing Town water was provided. Mr. Mills said Arlene Wilson Associates had taken two water samples and Mr. Greelish replied that they had been taken from the pond. Mr. Mills said that there are two test wells on the site. Mr. Princi said there are four wells on the site and Mr. DeMartino said they would have no problem in taking new samples.
