BOARD OF APPEALS Minutes - May 24, 1989 Page 6. <br />Mr. Furlani said the biggest,problem is that the building went up <br />without proper notification. Ms. Driscoll commented that no one objects <br />to the boatyard but that the changes should not be substantially more <br />non -conforming than the previous use. <br />Mr. Virgilio asked Mr. Burtis how many buildings had been removed. <br />Mr. Burtis replied that 14 had been torn down, cottages and sheds. <br />Mr. Hanrahan asked for a show of hands of those in favor and opposed. <br />Mr. Halpern moved to take the petition under advisement. Ms. Hawver <br />seconded. All agreed. <br />P. F. O'Connor - (Owners of record: Subon Co. and Austin B. O'Brien, TR) <br />Requests a Special Permit under Section 6.3.E.8 and 6.3.G.6 of the Land <br />Use Regulations for permission to operate a lumber yard/storage in a <br />C-2 and I-1 zoning district on property located on Roue 130 (Map 19, <br />Blocks 10 and 11) Mashpee, MA. (Request for re -issue of SP -86-02-012) <br />P. F. O'Connor - (Owners of record: Subon Co. and Austin B. O'Brien, TR) <br />Requests a Variance under Section 8.5 of the Land Space Requirements for <br />permission to vary the parking requirements in a C-2 and I-1 zoning district <br />on property located on Route 130 (Map 19, Blocks 10 and 11) Mashpee, MA. <br />(Request for re -issue of V-86-02-013) <br />• Members sitting: W. Hanrahan, C. Hawver, E. Govoni <br />Mr. O'Connor explained that the petitions were the same as requested <br />in 1986. Due to economic conditions he had not proceeded with the <br />construction. Mr. Hanrahan read the details from the 1986 decisions. <br />Mr. Govoni explained that the lot coverage provisions in the <br />zoning by-law had changed since the original permit was issued. <br />Tony Ferragamo, Chairman of the Planning Board, said that the new <br />lot coverage provisions make it difficult to plan any industrial buildings. <br />He said it is almost impossible to plan a building with 30% of impervious <br />area and that 50% seems to be the operating average. He said Design <br />Review had considered the O'Connor plan a good plan and the landscaping <br />was good. He said that the lot coverage restrictions under the new <br />Groundwater Protection District were not covered in the advertising and <br />a new permit application would be required. <br />Mr. Boyd explained that Mr. O'Connor could have put in the foundation <br />before the permits expired but he had asked him to delay until he came <br />before the Board again. <br />. Ms. Hawver stated that it was a good plan in 1986 and Mr. O'Connor <br />had shown good faith by not commencing construction. Ms. Hawver moved <br />to grant the Special Permit to operate a lumber yard and storage in a <br />• C-1 zoning district. Mr. Govoni seconded. All agreed. <br />
