Board of Appeals Minutes - August 12, 1998 2.
sides by land owned by the Town of Mashpee. The property is currently under agreement
for the proposed construction of a 5600 square foot building. There is a combined
frontage of 500 feet along Route 151. A drive around the back to the lower level will
accommodate a three-car garage, storage space, office area and embalming rooms. A
three-chapel complex along with office space and a viewing room is planned on the first
level of the building. The projected capacity is for 360 people with 103 parking spaces
required. One hundred fourteen parking spaces are proposed. Right-turn in and right-turn
out only access, as well as deceleration and acceleration lanes to facilitate traffic entering
and exiting onto Route 151 are planned. Passage is also proposed to use the access
already being utilized by the Fire and Police Departments to allow a left-hand turn. He
indicated that the commercial use would be of a low impact nature, creating some traffic,
but with very little demand on municipal use and no adverse impact on any resource area.
The proposal does conform with zoning by-laws with regard to lot coverage, setbacks and
number of required parking spaces.
Mr. Kirrane pointed out that the variance is requested to allow for a 100 foot front
frontage relief as nothing can be done on this lot if the variance is not granted. The rear
yard setback variance is requested to allow 50 feet, a 10 foot relief. Bates Road appears
to be the boundary line between the residentially zoned and commercially zoned areas. A
hardship is created by the odd shape of the lot and its narrowing from east to west. The
75 foot front setback and 50 foot rear setback would make it impossible to develop on this
land.
Mr. Kirrane also submitted revised landscape plans prepared after meeting with the Design
Review Committee. The committee requested more planting in order to screen the
parking areas. He also presented the rendering of the proposed building, remarking that,
to his knowledge, this is the first request for a mortuary and funeral home in the Town of
Mashpee. No comments were received from abutters.
Questions from the Board included concerns about the tum-around in the parking lot,dry
wells, drainage and traffic enteringlexiting.
Memos from the Planning Board and the Design Review Committee were considered.
The only comments received from the town residents concerned traffic on Route 151. Mr.
Dorgan noted that hours of operation for a funeral home are normally a few hours a day,
whereas commercial use of a different nature would be all day long.
Mr. Dorgan moved to grant the Variance of a 10 foot rear setback, 100 foot front setback,
subject to findings 1-4 of Variance criteria.
Mr. Nelson seconded. All agreed.
Mr. Dorgan moved to grant the special permit with the following conditions:
