-able orders of those empowered to enforce same, <br /> or resists them in the discharge of their duties <br /> shall be fined not less than $10.00 nor more than <br /> $50 .00 for the first violation and not less than <br /> $25 .00 nor more than $50. 00 for repeated violations . '! <br /> Section 4. 7. 7 Signs . The Harbormaster or Assistant Harbormaster <br /> shall see that speed and water skiing regulations, <br /> safety and general rules and regulations are posted <br /> at all public landings on all ponds within the Town. <br /> Further signs and markers may be placed at strategic <br /> locations throughout the waterways . <br /> Section 4. 7.8 Jurisdiction. <br /> a. Nothing contained herein shall be held or construed <br /> to supercede , conflict with , interfere with, or limit <br /> jurisdiction of the United States Government with respect <br /> to the enforcement of the navigation, shipping, anchor- <br /> age and associated laws of the United States , or to <br /> diminish the provisions of any lawful regulation of <br /> the Division of Marine and Recreational Vehicles , of <br /> laws of the Commonwealth of Massachusetts . <br /> b. In the event that any provision, section, or <br /> clause of this by-law is hereafter judically found <br /> to be invalid, such decision, invalidity or voidance <br /> shall not affect the validity of the remaining portions <br /> of this by-law. <br /> r <br /> Article 4. 8 Use , Care, Regulation and Control of Public Beaches <br /> Section 4 .8. 1 Fires . Setting or maintaining fires on all beaches <br /> is prohibited, except on approval of the Board of <br /> Selectmen and by special written permit therefor <br /> issued by the Mashpee Fire Department. <br /> i <br /> Section 4 .8.2 Alcoholic Beverages . The use of alcoholic beverages , <br /> including the bringing of alcoholic beverages on any <br /> of the public beaches , is absolutely prohibited. <br /> Section 4. 8. 3 Baseball or Softball. The playing of baseball or <br /> softball on said public beaches is prohibited. <br /> Section 4 . 8.4 Dogs . No dogs shall be brought upon any of said <br /> public beaches nor permitted thereon. <br /> Section 4.8. 5 Hours Open to Public. The Board of Selectmen may <br /> regulate the hours that said public beaches are open <br /> to the public. <br /> (Amended at Special Town Meeting November 9 , 1981, <br /> Approved by Attorney General February 16, 1982) <br /> Section 4 . 8. 6 Littering.
